Tragedy at Trader Joe's

A tragic story out of Los Angeles illustrates why it's so important for anyone who owns, carries or uses a gun for self-defense to always follow the rules of gun safety — specifically, to know the target and what's beyond (and around) it.

According to Fox6Now.com, "a store worker killed in a gunbattle [sic] before a suspect took hostages in a crowded supermarket was hit by a police bullet, Police Chief Michel Moore said Tuesday."

That worker, Melyda Corado, was fatally struck when one the rounds fired by an officer missed the suspect, Gene Evin Atkins, and entered Corado's body after passing through her arm.

Atkins fired two rounds at officers as he entered Trader Joe's, and officers fired back just as Corado was leaving the store.

"In deciding whether to open fire, the officers had to consider whether the suspect in what was already a long-running series of violent events would become an active shooter in a market crowded with weekend shoppers, Moore said," according to a Fox6Now report.

That series of violent events included Atkins shooting and wounding his grandmother, stealing a car, kidnapping a 17-year-old girl who was grazed by one of his bullets, getting into a car chase with police, firing at officers and running into a Trader Joe's, where he later took hostages.

According to the Los Angeles Times, "Charles 'Sid' Heal, a retired L.A. County sheriff's commander and expert on law enforcement shootings," said that "the suspect created the situation and law enforcement inherited it."

He also noted that "Atkins could have entered the store and shot those inside."

Remember, police officers have an entirely different level of responsibility than do private citizens when it comes to stopping — and especially pursuing — a potentially lethal threat.

Even so, it pays to remember that police are not immune to the stressors of a violent encounter. In the dynamics of an incident, physiological effects such as time distortion and tunnel vision can certainly come into play.

In the Los Angeles Times, Heal suggested that "there is no easy answer."

"We try to have a clear field of fire, but obviously the suspect has a substantial, even a decisive, advantage if we don't return fire," he added.

I share this story not to point fingers at law enforcement but to remind anyone who owns and carries a gun that it's a hefty responsibility and that, ultimately, you are responsible for every single round that leaves your firearm.

You must always know your target and what's around it.

Remember, the police in this instance had a duty to fulfill. They were chasing after a suspect because they HAD to, and there were innocents inside the store they also had to think about.

As a private citizen, you are not required to follow and neutralize a threat if you are no longer in imminent danger. Your best bet might be to escape to a place of relative safety and then call 911.

Despite the unfair and tragic outcome, which, in my opinion, falls squarely on the dangerous and violent perpetrator, police likely saved lives in this situation. My prayers to Melyda Corado, her friends and family, and the officer who is certainly now living his "worst nightmare."

Acting in Imperfect Conditions...
BY TIM SCHMIDT - USCCA FOUNDER Last week I brought you a tragic story out of California in which an errant bullet from a police officer's gun struck and killed an innocent Trader Joe's worker.

Melyda Corado was fatally struck when a round fired by an officer missed a suspect, identified as Gene Evin Atkins, and entered Corado's body after passing through her arm.

Since I touched a bit on the notion of police officers' differing level of responsibility when it comes to pursuing dangerous suspects, I thought it might be helpful to expand on something called the "Greater Danger Theory."

Kevin Michalowski, executive editor of Concealed Carry Magazine, explained that the Greater Danger Theory is something all police officers learn in training. The gist of it is this:

Will an officer's failure to act pose a greater danger to others than his actions at the time?

If we return to the situation in Los Angeles, the Greater Danger Theory might give us more insight into the officer's course of action. That officer had to weigh his decision to shoot (and all the potential risks shooting posed) against the potential danger of the alternative (not shooting). He determined (in seconds or less) that the risk of potentially hitting an innocent bystander outweighed the risk of the armed attacker entering a grocery store full of innocent bystanders. The death of Corado was an unfortunate and tragic byproduct of the police officer's attempt to keep a dangerous situation from becoming even more dangerous. (Consider how many people could have been hurt or killed inside the store if the officer had failed to act outside the store.)

Remember that the risk to law enforcement officers is also part of that equation. The police actively put themselves in danger every time they put on their uniforms. Concealed Carry Magazine Senior Editor Ed Combs, a former sheriff's deputy, is fond of saying that "there is no routine call in law enforcement."

A recent, sad example of this took place in Milwaukee just last week when Officer Michael Michalski was ambushed while searching for a suspect in a house.

According to the Journal Sentinel, "Jonathan Copeland Jr. is accused of shooting Michalski once in the head as the officer climbed a rear staircase."

Clearly, Michalski had a duty to pursue the suspect. But no doubt he also considered the potential consequences of what might happen if he didn't stop the threat. (According to the Journal Sentinel, Copeland had, just days earlier, "texted his wife ... warning that he would shoot police if they came after him. She had called police ... to report Copeland's threats to shoot up her house for not paying him for an unspecified expense.")

It's always tragic when there is a loss of innocent life. In Los Angeles and Milwaukee, respectively, Corado and Michalski paid the ultimate, unfair price because of the actions of dangerous and violent perpetrators. Luckily, both of these perpetrators were stopped, and now we must trust that they will be brought to justice.

So why am I telling you all this? Well, the Greater Danger Theory applies to police officers, but it also applies to everyday citizens who carry firearms for self-protection and the protection of those they love.

According to Kevin, "You may employ deadly force without effective target isolation when the danger presented by your failure to act would be greater than the danger of your actions."

He continues: "Notice that we say 'may' employ deadly force. As a private citizen, you are never required to use such force, and you will not be judged for not using it. The other side of the discussion is that the Greater Danger Theory is not a 'get out jail free card.' Your actions MUST be objectively reasonable under the circumstances. That means the Greater Danger Theory is only one element that will be considered when police and prosecutors evaluate your actions."

Clearly, there are no easy answers here.

I pray that you and I will never be forced into such a situation. As with all things self-defense-related, it pays to think about it before you decide to act (or not act) on it.

A reader recently reached out to our Member Services department asking why we publish information about legal costs and other such downsides of self-defense actions. The person was suggesting that those who know such things might hesitate during a self-defense incident because they would be thinking about all the potential risks involved.I responded with this: “We present the information concerning legal costs, emotional trauma, family concerns, civil litigation and the other negative elements of self-defense because it is our responsibility to present the most complete picture of every aspect of a deadly force incident. For the same reason, we published photos of an actual gunshot wound. People need to know what they are getting into. They need to think first about conflict avoidance. If we truly believe deadly force to be the last resort, we need to honestly and openly tell people why it must be the last resort. I do not want people to hesitate at the moment of truth, but I want them to reach that moment with a full understanding of what they can expect.”Using deadly force is not something anyone should do lightly or without lots of forethought. At the time of the incident, you need to act quickly, but you also need to act correctly. Your life, your freedom and your financial well-being depend on the decisions you make under extreme stress. You must have a full understanding of the potential downside before you press the trigger, swing the knife or bludgeon someone with a frying pan.You’ve heard the saying, “I’d rather be judged by 12 than carried by six.” True words. But that statement presents only two options: kill or die. It does not include the full spectrum of the event. That spectrum begins well before the fight starts and does not conclude until you have emotionally come to terms with your actions. If you only train to fight, you are ignoring the greater part of the entire battle.About a decade ago, Massad Ayoob told me a good portion of my training should include drawing, acquiring the sight picture and keeping my finger off the trigger. “If you train yourself to press the trigger every time, you will press the trigger every time,” he said. “But what if the person sees you reach for your gun and surrenders or runs away? You have trained your body to draw and fire, and that is what your body will do when you are under stress. You may have to fire, or you may not. You will have to decide quickly, but you still have to decide.”There are a lot of bad things that can happen to you after you win a fight. You need to know about them precisely because knowing about them might prompt you to avoid a fight more actively. I want you to actively avoid fights. To fight is to risk death. There is no need to take that risk if you are not forced to do so.Do all you can to avoid the fight because the fight sucks. The aftermath sucks. The entire situation sucks, and the more you know about it, the more likely you are to actively take the steps that will keep you out of harm’s way.Don’t get me wrong. I still want you to fight effectively and ruthlessly when the time comes. I just want to make sure you have done everything you can to ensure your ruthless actions really are the last resort.

District of Columbia v. Heller Revisited

"The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home."

So held the Supreme Court of the United States in a 5-4 decision on June 26, 2008, in the landmark District of Columbia v. Heller case.

According to SupremeCourt.gov, the case was argued March 18, 2008, and was based on a suit filed by Dick Anthony Heller against Washington, D.C. The background of that suit, laid out in the Supreme Court Syllabus, reads as follows:

District of Columbia law bans handgun possession by making it a crime to carry an unregistered firearm and prohibiting the registration of handguns; provides separately that no person may carry an unlicensed handgun, but authorizes the police chief to issue 1-year licenses; and requires residents to keep lawfully owned firearms unloaded and disassembled or bound by a trigger lock or similar device. Respondent Heller, a D.C. special policeman, applied to register a handgun he wished to keep at home, but the District refused. He filed this suit seeking, on Second Amendment grounds, to enjoin the city from enforcing the bar on handgun registration, the licensing requirement insofar as it prohibits carrying an unlicensed firearm in the home and the trigger-lock requirement insofar as it prohibits the use of functional firearms in the home.

It continues:

The District Court dismissed the suit, but the D.C. Circuit reversed, holding that the Second Amendment protects an individual's right to possess firearms and that the city's total ban on handguns, as well as its requirement that firearms in the home be kept nonfunctional even when necessary for self-defense, violated that right.

The U.S. Supreme Court sided with Heller 5-4. Townhall points out that "Justices Scalia, Roberts, Kennedy, Thomas and Alito [ruled] in Heller's favor. Justices Stevens, Souter, Ginsburg and Breyer voted in favor of Washington, D.C."

Because Tuesday marked the 10-year anniversary of that paramount decision, Townhall recently reached out to a few prominent voices in the Second Amendment community, including Second Amendment Foundation Founder and Executive Vice President Alan Gottlieb, National Shooting Sports Foundation (NSSF) Senior Vice President and General Counsel Larry Keane and Gun Owners of America Executive Director Erich Pratt. In Townhall's review of the historic case, Gottlieb calls it "the cornerstone of Second Amendment litigation." He says that "without it, the McDonald Supreme Court decision that incorporated Fourteenth Amendment protection of Second Amendment rights would not have been possible. And without McDonald, all of the victories in federal court that have struck down a number of other anti-gun rights laws would not have happened."

Pratt told Townhall that "June 26, 2008, was a great day for freedom" because "the highest court in the land recognized the individual right of decent people to own a firearm for protection." He also claims that Heller "was not the end of the fight." He says "there are still many judges who are ignoring the Heller decision and who, quite frankly, ignore the Second Amendment as well. And so we continue to fight for our freedoms — in the courts, in the Congress and in state legislatures across the country."

Indeed.

Let's take a moment to express our gratitude for what this decision meant — and continues to mean — for law-abiding citizens. And then let's get back in the fight. There is still much work to be done.

BY TIM SCHMIDT - USCCA FOUNDER "It's sad. But thank God somebody was there to deal with it."

So said Sergeant Bill Amos, of the Titusville Police Department, in an interview with WKMG News 6 following an incident at Isaac Campbell Park in Brevard County, Florida, last Saturday.

According to the City of Titusville website, "a man involved in a fistfight with another person at a crowded park ... returned several minutes later with a gun and opened fire. The gunman was then shot by a bystander, who was lawfully licensed to carry a firearm."

Police are hailing that bystander as a hero, Guns.com reports.

Florida Today said that the bystander, "an unidentified vendor with a licensed, concealed weapon, drew his gun on the shooter who was running toward the crowd and rapidly returned fire." The same source also reported that "police would only say that the bystander was lawfully carrying his weapon and that he was cooperating."

The incident occurred at the "Peace in the City" cookout, "organized as a memorial to Tony Butler, a homicide victim whose body was discovered in a burned-out car last month," according to Florida Today.

Fox 32 out of Chicago reported that hundreds of people attended the event, including dozens of children who "came to get free school supplies and backpacks."

John Lott, founder and president of the Crime Prevention Research Center, noted in a Fox News editorial that "fortunately, only the attacker was injured in Titusville" and that "the presence of an armed 'good guy' prevented the Titusville shooting from turning into a tragedy like [the] school shooting in Parkland, Florida, in February."

He continued: "Law enforcement officers cannot be everywhere, so the presence of armed citizens is vital to provide an instant response to attackers. The police responded within minutes, but the gun permit holder was right there the moment the attack started, enabling him to stop the attacker almost immediately."

This is one of the things we emphasize often here at the USCCA: the unfortunate reality that the police can't be everywhere all the time. That's why legally carrying a firearm and, of course, being trained in its use is so important. It means having a potentially lifesaving tool at hand the instant you need it.

Thank God this particular citizen understood that reality. The outcome was about as good as we can hope for in a situation like this.

The City of Titusville website says that "this case remains an active investigation by the Titusville Police Department. Detectives have consulted with the State Attorney's office and no charges are expected against the bystander, as his actions were within the law based on the preliminary investigation."

In fact, Fox 32 reports that "police say [the armed citizen] did the right thing. 'Based on the information that we've gathered,' said Titusville Police Sgt. William Amos, 'this person stepped in and saved a lot of people's lives.'"

Indeed. Score another one for the good guys.

Congratulations, Sergeant Tim Wilz!
BY TIM SCHMIDT - USCCA FOUNDER I just love it when the good guy wins.
That's what happened Tuesday night in Waupaca, Wisconsin, about two hours north of USCCA headquarters in West Bend.

Tim Wilz, a patrol sergeant with the Waupaca County Sheriff's Office, cruised to victory in the Aug. 14 primary election for Waupaca County sheriff.

According to WaupacaNow.com, "although Waupaca County Sheriff Brad Hardel dropped out of the race, his name remained on the Republican ballot. His challenger, Sgt. Tim Wilz, received 3,464 votes against Hardel's 1,345."

Hardel announced June 11 that he was withdrawing from the race because of plans to retire at the end of the year, WaupacaNow.com reported, but Waupaca County Clerk Jill Lodgewegen "said all the names for the ballot were certified during the first week of June."

Wilz filed to run for sheriff back in April and continued to campaign even after Hardel's announcement — a decision that I personally think says a lot about Wilz' character.

Now, you're probably wondering why the heck I'm telling you all of this. Sgt. Tim Wilz of the Waupaca County Sheriff's Office regularly appears in Concealed Carry Magazine as a good guy … because he IS one!
Well, it just so happens that Sgt. Wilz appeared on one of my very favorite covers of Concealed Carry Magazine … and he really IS one of the good guys.

According to WaupacaNow.com, Wilz "is a training coordinator, responsible for training officers in the use of firearms, stun guns, defensive tactics, basic strikes and control, pursuit and high-risk traffic stops. Wilz said one of his goals is to 'work closely with school administrators and state government to obtain grants to improve school safety with a focus on adding a school resource officer in all our schools in the county.' School resource officers, like those in Waupaca and Clintonville, help build trust and relationships between law enforcement and students. 'Until students realize that the school resource officer is there for them, we will not be able to stop bullying or be aware of students of interest,' Wilz said."

CCM Senior Editor Ed Combs, who worked with Sgt. Wilz at the Waupaca County Sheriff's Office for a number of years, wasn't surprised by Tuesday's results. He told me: "You always wanted to work with Sergeant Wilz, either out in the community or in a training capacity. He's a very experienced lawman and an excellent communicator, both of which were major departmental assets. I'm certain those traits will continue to serve the people of Waupaca County well for some time to come."

Moving into a discussion of Wilz's contributions to Concealed Carry Magazine (you've likely seen him in more photos than just the cover shot above, and he's also appeared in several of our Proving Ground videos), Ed mentioned that "working with someone like him makes a big difference when you're taking photos for a gun-centered magazine. I've always been a big believer in the fact that it's a lot easier for me to show someone who already knows how to handle a gun how to stand still for a photo than to show a professional model how to properly handle a pistol, and that's why we turn to men like Wilz. He makes our job easy."

The Appleton Post-Crescent reports that "there are no Democratic candidates for sheriff in [Waupaca County], so [Wilz] will be unopposed in the Nov. 6 general election."

Congratulations, Sgt. Wilz!
