read for a full listing but this is what I think applies

1)(a) It is unlawful for any person or motor vehicle dealer as defined in s. 320.27 to offer or display for retail sale or lease, sell, lease, or transfer title to, a motor vehicle in Florida that has been tampered with in violation of this section, as determined pursuant to subsection (7). Tampering is defined as the dismantling, removal, or rendering ineffective of any air pollution control device or system which has been installed on a motor vehicle by the vehicle manufacturer except to replace such device or system with a device or system equivalent in design and function to the part that was originally installed on the motor vehicle. All motor vehicles sold, reassigned, or traded to a licensed motor vehicle dealer are exempt from this paragraph.

basically you can't dismantle remove or make ineffective the polution control device, it lists lower on the link things like egr and cat, however you can replace them with equivalent design. also the muffler is not a polution control device since it has no filters, it just has baffles that deflect sound but all the exhaust comes out. it is the cat that controls the polutants and I highly doubt this chick got on here knees and looked for a cat. the muffler is fair game as long as its not too loud. my muffler is a straight through pipe with a tunnel of screen on the inside ( you could drop a quarter straight through it) and its a dc sports tcs cat back system so you know its carb eq'd.

not properly equiped is ambiguous but in court you can argue that it had the necessary and required equipment or its equivalent ( enter carb cert ), also private property, also she wrote modified exhaust put cited you for 316.610 Safety of vehicle; inspection. I have heard of people getting off becaus the cop transposed 2 numbers, like your case they wrote 316.160 instead of 316.610 and it got tossed on that, so the judges can be hard on the cops for stupid fuckups. your statute has to do with any unsafe vehicle conditions not just "modified exhaust" so you should get off on that if not because of everything else.

print up all the info on the links I gave you and read them, also take them to court to reference to if need be ( plus it looks like you did your homework ) I will check for a statute that limits the police authority on private property in relation to traffic violations and let you know what I find.

no prob dude, I love this kind of shit. I am all for lawenforcement and I can see the cops side ie using some bs reason like loud exhaust as probable cause (pc) for a stop, then use the stop for pc to get you on some other charge like drug possesion, but if the stop leads to nothing, no warrants or other shit, then they should let you go. now if they have you dead to rights for doing 80 in a 35mph then "press hard makes five copies" is a phrase you will hear. also some of the cops have forgotten the intent of the law and try to push the letter of the law. my dad was driving my car and got a ticket for green turn signals. the cop was going the opposite direction and caught a glimpse out of the corner of his eye. now the intent of turn signals is to let others know what you are doing, if you can see this while going the other direction then they are working. I understand keeping blue strobes for cops, we need something to signify authority so that we can yield to them on the streets, but purple, yellow, green, c'mon.

also when is the last time you didn't notice the car with the underbody neons????? now when was the last time you didn't notice the car in front of you was stopping? you see red brakelights all the time so you kinda tune them out. and in our small cars we need to be noticed, especially at night.

if you had actually f'd up and she had you then I'd say your screwed, but since it seems she f'd up every step of the way I say nail her tits to the wall.

This is 1 reason I like Spring Hill the cops dont care how loud your car is unless its after midnight but even then they dont really care. I was runnin open header for about a month and never got stopped, then i get my exhaust and went to tampa and got stopped for having a modified exhaust. I call to make a court date and the cop had changed the ticket to noise polution. and I cant fight it cause I dant have a cat on my car so I got screwed on that one.

Yeah, the funny thing is that the cop said I had an illegal exhaust SYSTEM- I don't ever remember her climbing UNDER my car to look at my muffler, pipe, cat or header...hmmmmm....

go pick up this months super street,theres about 10 pages on every action you need to take for getting rid of it,one will be getting the carb eo number or whatever its called,and they will probbaly test it for decibals,super street bought a tester from radio shack for under 100 bucks.-sickofalltezzas

the statute says "motor vehicle" a motorcycle is a motor vehicle so the decible level still applies, the problem is if a cop hits the lights to stop you and you twist your wrist your gone and the cop has to end the pursuit, so most of the time they don't even bother.
