Default insurance claim, what should i do?

it seems to me that we have some very experienced users toward insurance, i figure i will give it a try here.

about a week ago, a lady hit me on the side of my car at 2:30 in the morning, she left a note with her information and insurance policy information on my car. i went to a local reputable auto body shop and got an estimate. then, i called her a few days before chrismas and told her the estimated total for the repair to see she rather pay out of her own pocket or have me go get a claim. which she told me to just go to her insurance.

now, where am i suppose to take the claim to? am i suppose to call her insurance company? or am i suppose to call my insurance company? please lead me toward the right path

thanks in advance

9 times out of 10 if you go to her insurance company personaly with no kind of representation behind you they will dick you around forever and fuck you over in the end. Your insurance company shouldnt see you as a risk since obviously you were parked and it was her full responsibility.

If it was me I would take it to my insurance company and let them deal with it.

Whos your insurance company and whos is hers?

If you go through your own insurance you will have to pay the deductible, but you will get it back after the insurance companies settle. I had a similar thing happen to me in August and I am still waiting to get paid by the other insurance company.

What insurance company do you have muddy? I never had to pay a deductible when it was the other persons fault. The insurance company took care of everything, car was fixed right away and my insurance rates never went up.

Problems like this is when it helps to have a good insurance company, not one of those cheep rate ones.

reguardless of fault it's within your progressive policy agreement to report any and all incidents with the insured vehicle.

If you contact your insurance "claims" group, this will count against you, regardless of who pays in the end.

DO NOT CONTACT YOUR CLAIMS REP! Contact HERS!!!

Personal Lines insurance is based off of claims frequency, not payout. Frequency is too high, you get cancelled, and this WILL count against you if you contact your insurer.

But feel free to contact your agent for further guidance, they will assist you (AGENT, not CLAIMS). Also, if you have issues, contact the Florida Dept of Insurance. They will help for FREE.
