Ok, I had to post on this one. First of all, it is required that leo's read the implied consent waiver just prior to the breath test. I will assure you that the leo reading the waiver did not write it and it has to be read word for word. Also, 99% of leo's could care less about their conviction rate when it comes to DUI's. Violent crimes and drugs is a different story though. Second, for the firefighter scenario.....ALL leo's extend courtesy to police/fire employees whether they admit it or not. However, sometimes there are circumstances that are not within our control and courtesy cannot be given (invloving a crash or similar). After all, almost all traffic laws and enforcement "officer descretion" can be utilized. And either way, both firefighters would likely loose there jobs if they blew or not. IF they did..its rock solid DUI. If they didn't then they get canned for "Conduct unbecoming".

As for the to blow or not to blow......Its simple. You have to chose at that moment to fight the DUI or plead (tough to do when drunk). If you blow, you might as well plead and have your DL back quickly and lesser fines. If you dont blow, You better hope you beat the charge. If not, your Dl is gone for longer and fines are heavier (usually). None of this applies to the work permit....the work permit is only used til the court preceedings are finished. SOmetimes the courts withdraws the permit and you have nothing at all (rarely). Usually you get to keep the work permit and pay lots of fines.

Maybe in Manatee Co.....I will be you $50 Hills doesnt read an affidavit prior to blowing. And whether you blow or not, does depend on when you eligible here in Hills, Pasco and Pinellas. That I'll throw $100 on. This came directly from the mouth of one of the most well known $$$$$ attorneys locally. He came in with a buddy of his for a bond. His exact word were, "If you have been drinking and get pulled for a DUI, You exercise your right to remain silent and I will get it thrown out, PERIOD.'

I know 2 that guarantee the same thing or you owe them nothing. Told me the second an officer asks you if you've been drinking and you think you might blow over its time to zip it and understand the rest of the evening is going to be fucked up until you are released.

I look at it this way. Either way its going to cost me the same amount of money. When you add up the fines, court costs, any classes or other fees they make you pay plus time off work to do community service and then add up what your insurance company will rape from you for the next 5,.. thats (F I V E) years for a DUI with all those points plus the loss of your license and the $150 its going to cost to get it reinstated,.. I'd rather give my money to a rat fink lawyer then the greedy corrupt court system,.. at least I wont have the points and can still drive afterwards.

I understand that if your that worried about it then dont drive after you've been drinking. Thats all nice and good. I've been pretty good about it by getting my wife to drive after I've had a few. But she isnt always there and I can drive just fine with my body size after drinking a few with my father inlaw. I do know when to say when. If I've had more then 8 beers in a 2 - 3 hour period I wont drive. But if I've only had 3 or 4 and get pulled over for any reason other then crossing the yellow line and the officer even remotely smells alcohol on my breath,.. I'm not blowing in anything. I know for a fact in the end I will not have a DUI on my record and I will still have my license even though the law stipulates otherwise for not blowing. Heh,.. I wont even have to show up for court.

Well maybe not for a DUI,.. But last year I got 2 speeding tickets back to back on the same day on 54. One just before Suncoast parkway and then another just before Gun Hwy. I never had to show up in court. Lawyer called me and said it was all taken care of. Mailed me the papers. And that was that. No school,.. no nothing. Same lawyer friend of my wife that told me how to handle a DUI. My wife even told me how to handle a DUI and when she was a Sheriff''s Dept in Orlando she wrote out many DUI arrests when she was on the road.

Or if you want to get technical with professional courtesy,.. all I would have to do is use my get out of jail free card by giving the officer my wife's badge number,.. he'll call her,.. she'll get a rashon of shit,.. I'll get my ass chewed out,.. she'll have to come pick me up,.. but I can guarantee,.. I wont get a DUI. Professional courtesy right there. (smirk)

If you get pulled....talk to the cop or you'll get arrested for other charges (if he has cause to stop you that is). However, if he asks the drinking question....by all means use your right to remain silent. Yes, that is a pretty sure way to beat the DUI in court. Its also a great way to get arrested for DUI. Just be tactiful and it could work out well.

I agree with the fuck cops...kinda....nobody likes a traffic cop that gets his rocks off writing tickets. FHP is the worst.
but other aspects are needed and wanted widely. I am in law enforcement (so Im watching lol) but I havent done any patrol work in a long time. Ive made two arrests for DUI in my career, both over 5 years ago....so Im no pro with DUI's

Hurst.....with a wife in LE, it would be pretty tough to get a DUI. Most people wont say it. BUt, thats just how it goes. If you are one, married to one, hell even good friends with one...No DUI.
