i had a former largo officer talk me into fighting the ticket in court saying it wouldnt matter because it was on private property...i went to court, explained everything, even saying i talked to the former cop and thats what he said as well...anyway this made no difference and the judge said this was incorrect and i still got shafted

 

Your exactly right UNLESS someone calls them or complains ! I could smack my wife in my dorrway in front of a cop and he cant come in UNLESS SHE says come in and help me or i say its okfor you to come in they need a warrent or cause to forcefully enter my home. Same With lots My womens car was broken into at the mall you know what the cops said oh well we cant do anything file a report with the mall security. NOTHING they can do I just found you the damn Statute and Everything and you still wanna argue ! typical TR

 

you're partially right. a cop could enter your house without permission to stop you from hitting your wife. they have a right to enter private property and protect the public. now endangering people in a parking lot could be left to the cop's discretion, however i'd agree that in a private area like an industrial park, the cops would not be able to bust someone for streetracing. they could charge them with public endangerment, trespassing (if the owner pressed charges), and many communities have "menace" laws as catch-alls that wouldn't actually hold up with a decent lawyer.

i think the problem here is that a good lawyer would beat a "street racing" ticket if the race occured on private property. but an idiot who went into court without representation would get laughed at by the judge, because what are they going to do without a lawyer and proper knowledge of the laws and ability to reference those laws? as for burnouts in parking lots, if the cops were smart, they'd arrest those people for disturbing the peace and public endangerment (or whatever similar laws they have in the particular jurisdiction). a decent lawyer could probably get you off (i.e. consenting parties around the burnout, etc.), but a layman on his own would get busted.

 

THANK YOU !!! The Police only have the power to stop endangerment of public !! They have NO MOTOR VEHICLE Jusidiction ! If you goto court with no one representing you of course they will laugh at you, to them your a Dumb Street Racing Punk Kid. Ive fought MANY tickets like this and won, 1 for having a nice lawyer and 2 One of my Close Freinds is a PCSO Detective. KNowledge is key ! Ive had cops catch me in parking lots and ask to search my car or whatnot Ive said NO and left ! NOTHING THEY CAN DO !!!! Now if there is something endangering The public and no people standing there watching isnt PUBLIC they are participants THEN and ONLY THEN they can step in ! Industial parks off of County Roads or Hwys are PRIVATE the owners and tennents pay fees for the Buildings and Roads in the complex just because its paved doesnt mean cops can patrol it ! PRIVATE means PRIVATE to EVERYONE !!! Read the Statute I posted it states all of this Unless your to ignorent to read it !

 

Read Above and then go read the Statute and Argue with that !! Not all judges are right They make a JUDGMENT call on behalf of their understanding of the law and the power invested in them to make a desicion for the law ! Just because a cop says it is how it is doesnt mean Your fucked Get a lawyer genius ! Ive been busted Speeding 140 in a 75 and got away with it, EVEN WHEN THE JUDGE CONVICTED ME !! I Pled No contest Because i didnt have a lawyer, Once i got one GUess what My car Only was able to run 108 with the OEM Governer and the Hwy Patrol Never Paced me or Clocked me He Caught me coming off on a Off Ramp. The Ticket and Charges were dismissed ! 1 because the Cop didnt do his Job correctly and 2 I was in the Jurisdiction of the Local PD He wrote me a Ticket for the HWY When i was pulled on a County Road. Helps to have good representation ! Oh and did i mention i was street racing ! KNow the law !

 

9.42.100 Operating vehicles on private property prohibited.

A. No person shall operate or drive a motor vehicle, motorcycle, mini-bike, trail bike, dune buggy, motor scooter, jeep or other form or motor vehicular transportation upon the private property of another or upon any public property which is not subject to the provisions of the Vehicle Code of the state. These facilities include but are not limited to publically accessed parking lots, structures and/or gated areas after hours, during special occasions, etc.

B. The provisions of this section shall not apply to emergency vehicles, governmental agencies or to persons driving upon such property with the written consent of the owner or person in lawful possession of such property or to the owner himself, his family, employees, agents or lessees. (Prior code ยง 4620.2).

I do my research to buddy...and if you dont understand what this means, its saying, if you dont have written consent, your Trespassing and a cop has every right to pull you or break you up until you prove him wrong. On top of that, if your doing something stupid like racing or burning out in front of him, he can also charge you with that since you are already breaking the law by trespassing. Moral of the story, if your racing in an industrial area, you are just as at risk as being on US Hwy 19

 

+1 avoid the hassle all together by not being an asshole and respect others property. would you like it if someone did a burnout in your driveway while you weren't home? yea those marks are really attractive aren't they?
