Colorado Gun Laws: What You Should Know

USCCA - 05/20/2019

As a responsibly armed American, you already know how challenging it can be to stay up to date on gun laws…

Colorado gun owners, you’re in luck. We’ve gathered some of the most frequently asked firearms questions in your state. Read on for answers to some of the top questions regarding Colorado gun laws.

Can You Have a Gun in Your Car in Colorado?

Yes, you can carry a loaded, concealed firearm in a vehicle in Colorado. A permit is not required to carry a gun in your car.

Which States Have Reciprocity With Colorado?

The Colorado permit to carry a concealed weapon (CCW) is honored in 35 states. The USCCA Reciprocity Map provides detailed information on those states, along with restrictions that apply.

Do You Need a Permit to Open Carry in Colorado?

No. Open carry is legal in Colorado except in Denver County and other posted areas. The minimum age is 18 years old. Local governments may enact regulations prohibiting open carrying of firearms in a building or specific area within the local government’s jurisdiction (as long as signs are posted).

Do I Need a Concealed Carry Permit in Colorado?

Yes. Concealed carry is legal in Colorado for residents with a Colorado permit to carry a concealed weapon (CCW) and non-residents of states with which Colorado has reciprocity agreements. CCW permits can be issued to any resident at least 21 years old and not prohibited by law from possessing a firearm. Concealed carry permits require a firearms training course that has been state-approved.

Is Colorado a Stand Your Ground State?

While Colorado doesn’t have a “stand your ground” law, it is a Castle Doctrine state. It grants its citizens the “right to expect absolute safety within their own homes.” A person is justified in using physical force on another person in order to defend himself, herself or a third person. He or she may use a degree of force reasonably believed to be necessary to stop the attack of another person. There is no duty to retreat, and the law applies at a person’s residence or in another dwelling, which is referred to as a “make my day” statute. There is a duty to retreat outside a person’s residence. You may not legally use deadly force in Colorado in order to protect any other type of property.

Do You Have to Register a Gun in Colorado?

No. Firearms purchase permits or firearms registration are not required for handguns in Colorado.

Can You Carry a Gun While Hiking in Colorado?

Yes, with a valid Colorado permit to carry a concealed weapon (CCW) or a resident permit from a state with which Colorado has reciprocity. A handgun may be carried in Colorado parks, including state and national parks.

Default Armed Teachers Make Schools Safer BY TIM SCHMIDT - USCCA FOUNDER

Armed Teachers Make Schools Safer
BY TIM SCHMIDT - USCCA FOUNDER

With a recent rash of shootings being perpetrated at schools across the country, the safety of our students has been at the forefront of many of our minds as of late.

In two particular instances, it was unarmed students who took action and helped stop terrible evil-doers in their tracks.

At UNC Charlotte on April 30, Riley Howell rushed toward the perpetrator, knocking him off his feet and ultimately saving many lives.

According to Fox 6, "When a gunman walked into his classroom at the University of North Carolina at Charlotte campus, Riley Howell rushed toward him, police and Howell's family said. Charlotte-Mecklenburg Police Department Chief Kerr Putney said Howell ran at the gunman and knocked him off his feet — something that eventually helped police arrest the suspect. 'He's an athletically built young man and he took the fight to the assailant,' Putney said. 'Unfortunately, he had to give his life to do so, but he saved lives doing so.'"

At STEM School Highlands Ranch on May 7, Kendrick Castillo rushed the shooter, giving his fellow classmates time to escape. Castillo had previously told his father he would act if ever confronted by an active shooter — and that's exactly what he did.

According to USA Today, "An emotional John Castillo lauded his kind-hearted son as a hero. 'I want people to know about him,' he told ABC News. He also told NBC that he talked with Kendrick about what to do in a school shooting, advising him 'you don't have to be the hero.' But his son, who wanted to study electrical engineering in college, insisted he would act. 'You raised me this way. You raised me to be a good person. That's what I'm doing,' Castillo recalled."

The reason I bring up these two brave young men who sacrificed their own lives is because their actions show what can happen when people choose to fight back.

Imagine how many of these tragedies could be stopped — or prevented altogether — if the perpetrators knew people were going to put up a fight!

New research from the Crime Prevention Research Center (CPRC) sheds light on just that: the promising effect of teachers carrying guns.

Dr. John R. Lott, Jr. of the CPRC recently appeared on The Blaze to talk about his latest report, "Schools That Allow Teachers to Carry Guns Are Extremely Safe: Data on the Rate of Shootings and Accidents in Schools That Allow Teachers to Carry."

According to Lott, more than 1,000 school districts across the country have already moved to arm teachers.

"You just don't see shootings occurring in schools that have teachers carrying," he said.

Lott's latest research attempts to answer two important questions: "Does letting teachers carry create dangers?" And "might they deter attackers?"

Despite claims from Michael Bloomberg and others that arming teachers is "dangerous" for the students, Lott says "there's not one case where a student [has] gotten hold of a teacher's gun and done something wrong with it. There's not one case of a teacher accidentally shooting somebody."

And what about deterrence?

"Rather than having a sign in front of a school that says, 'This school is a gun-free zone,' there's a sign that says, 'Selective teachers at this school are armed and will use their guns to defend the students and themselves,'" Lott notes. "Does that deter people? The fact that you don't see one single attack at any of these schools during anything near school hours tell
Replys you that at least there's some evidence that they deter."

In response to Lott's claim of no shooting events or injuries in the districts that have already made the decision to arm teachers, Eric Bolling of Blaze TV said, "That's a staggering statistic. Love guns, hate guns ... when you have that kind of scorecard..."

Lott's report looks at several other interesting statistics, including feedback from law enforcement:

"Perhaps because police understand the difficulty of their jobs, they are strongly in favor of abolishing gun-free school zones. Shortly after the Sandy Hook Elementary School shooting in 2012, PoliceOne, a 450,000-member private organization of police (380,000 active, full-time and 70,000 retired officers), surveyed its members and found that 77 percent supported arming teachers and/or school staff. Eighty-six percent of the officers believed that casualties in mass public shootings would have been reduced or altogether prevented if legally armed citizens had been able to carry guns."

I highly encourage you to
read the full report here. This is really promising stuff.

Take Care and Stay Safe,

Alabama Gun Laws: What You Need to Know

USCCA - 07/22/2019
As a responsibly armed American, you already know how challenging it can be to stay up to date on changing gun laws…

Alabama gun owners, you’re in luck. We’ve gathered some of the most frequently asked firearms questions about your state. Read on for answers to some of the top questions regarding Alabama gun laws. (Not from Alabama? Check the Legal & Second Amendment tab on the side to find your state!)

Can You Conceal Carry at 18 in Alabama?

Yes. The minimum age to apply for an Alabama pistol permit is 18 years old. Open carry is legal at 18 years of age without a permit.

Can You Have a Loaded Gun in Your Car in Alabama?

A person may have a concealed and readily accessible handgun in a vehicle if he or she has an Alabama pistol permit or an out-of-state permit that Alabama honors. Without a permit, handguns must be unloaded and locked in a compartment or container that is in, or affixed securely to, the vehicle and out of reach of the driver and any passenger in the vehicle.

Is Alabama a ‘Stand Your Ground’ State?

Yes. In Alabama, you do not have a duty to retreat and are allowed to stand your ground. This is only if you are in a place where you have a right to be and are not engaged in unlawful activity. Alabama is also a Castle Doctrine state. Use of force in self-defense is generally presumed to be legal when that force is necessary to prevent imminent harm or injury to one’s self or another.

Do You Need a Concealed Carry Permit in Alabama?

Yes. Concealed carry is legal only with an Alabama pistol permit or a permit from a state that Alabama honors. Alabama does not require the applicant to complete a firearms safety course or otherwise demonstrate knowledge of firearms safety prior to issuance of a pistol permit. However, the USCCA recommends that anyone who makes the choice to carry a concealed firearm obtain as much training as possible in order to be a responsibly armed American. Alabama doesn’t issue permits to non-residents.

Which States Honor Alabama Pistol Permits?

An Alabama pistol permit is honored in 32 states. This includes the 12 permitless carry states (although age restrictions may apply) and the following:
  • Colorado (at least 21 years old)
  • Florida (at least 21 years old)
  • Georgia (at least 21 years old)
  • Idaho (at least 21 years old)
  • Indiana
  • Iowa (at least 21 years old)
  • Louisiana (at least 21 years old)
  • Michigan (at least 21 years old)
  • Montana
  • North Carolina (at least 21 years old)
  • North Dakota
  • Ohio (at least 21 years old)
  • Oklahoma (at least 21 years old)
  • Pennsylvania (at least 21 years old)
  • Tennessee (at least 21 years old)
  • Texas (at least 21 years old)
  • Utah (at least 21 years old)
  • Virginia (at least 21 years old)
  • Wisconsin (at least 21 years old)
  • Wyoming (at least 21 years old)

Can You Concealed Carry in a Bar in Alabama?

Yes. Those with an Alabama pistol permit or a permit from a state that Alabama honors may concealed carry in bars. If the establishment is posted restricting guns, however, one must abide by those rules.

As a responsibly armed American, regardless of the laws in your state, it is unwise to carry while under the influence of any substance that could impair your judgment, slow your reaction times or impact your decision-making abilities. Any decision you make while carrying a firearm could have life-altering consequences.

How Much Is a Gun Permit in Alabama?

Alabama state law allows each county sheriff to establish permit fees. However, new permits and renewal fees are generally $20 per year, so $100 for a 5-year permit. Active-duty military and non-disability retirees from active military duty who meet the conditions are eligible to obtain the pistol permit without paying a fee.

Oregon Gun Laws: What You Need to Know

USCCA - 07/15/2019
As a responsibly armed American, you already know how challenging it can be to stay up to date on changing gun laws…

Oregon gun owners, you’re in luck. We’ve gathered some of the most frequently asked firearms questions in your state. Read on for answers to some of the top questions regarding Oregon gun laws. (Not from Oregon? Check the “Legal & Second Amendment” category to find your state!)

Is Oregon a Right to Carry State?

Oregon is a shall-issue state with concealed carry applications processed at the county level by the local sheriff’s office. However, the sheriff has some discretion if there are reasonable grounds to believe that the applicant has been or is likely to be a danger to self or others. Open carry is legal in Oregon without a license, although local cities and counties are authorized to place restrictions on who may open carry in public places (including vehicles). The minimum age is 18 years old.

Can I Have a Gun in My Car in Oregon?

Yes, a person may have a concealed and readily accessible handgun in a vehicle if the person has an Oregon Concealed Handgun License (CHL). Without a permit, a loaded handgun must not be concealed nor readily accessible. However, local governments can set their own laws on public places, including vehicles. Oregon does not prohibit the open carrying of long guns in a vehicle.

Is Oregon a ‘Stand Your Ground’ State?

Oregon law does not explicitly reference a “stand your ground” law or Castle Doctrine by name. However, the combination of Oregon’s statutes on use of force and the interpretation by the Oregon Supreme Court in a 2007 ruling imply that state law doesn’t require a duty to retreat. This effectively indicates that Oregon is a Castle Doctrine state and a “stand your ground” state. Self-defense — even deadly physical force in certain situations — can be used to protect property and defend yourself from physical force, violence or attack. There is no duty to retreat.

Do You Need a Concealed Carry Permit in Oregon?

Yes. Concealed carry is legal only with an Oregon concealed handgun license (CHL). Oregon CHLs require an applicant to demonstrate competence with a handgun. This can be done through an approved firearms training course, through participation in an organized shooting competition or military experience. Non-residents who live in contiguous states may apply for a CHL. In terms of reciprocity, Oregon does not honor permits from any other states.

What States Does Oregon Concealed Carry Cover?

An Oregon Concealed Handgun License (CHL) is honored in 26 states, including the 12 permitless carry states: Alabama, Idaho, Indiana, Iowa, Michigan, Montana, Nebraska, Nevada, North Carolina, Ohio, Oklahoma, Tennessee, Utah and Virginia.

Can You Carry a Gun in Oregon State Parks?

Yes, only for those with an Oregon Concealed Handgun License (CHL).

Can an 18-Year-Old Open Carry a Handgun in Oregon?

Yes, open carry is legal in Oregon without a license, although local cities and counties are authorized to place restrictions on who may open carry in public places. The minimum age is 18.

Are 911 Calls Recorded?

USCCA - 07/13/2019

Are you prepared for what happens after you pull the trigger in self-defense?

After a stressful defensive event, especially one in which you are forced to draw and fire your gun, your body responds in several ways. This can sometimes affect what you remember and what you say. Are you prepared to make the 911 call after the event and provide clear, concise and helpful information?

In this week’s “Ask a Self-Defense Attorney” video, Attorney Tom Grieve discusses why being prepared to make that 911 call is so important.

Are 911 Calls Recorded?

Yes, 911 calls are recorded. And they can have a major impact on your self-defense case. After the stressful incident — but before you make the call — ask yourself if you are able to clearly articulate what happened. Sometimes, given your body’s natural responses to that stress, this call can create evidence that may be used against you later on.

The fact is, you need to think about who you are really talking to during this phone call. You’re not only talking to the person on the other end of the line but also the judge, the jury, the prosecutor, the media, your family and anyone who may possibly hear that recording when it comes up in any case.

About Tom Grieve, Grieve Law

Tom Grieve is one of the most respected criminal defense lawyers in Wisconsin. A highly awarded former prosecutor, he started Grieve Law, LLC, which is one of the top criminal defense firms in the state. He developed a nuanced knowledge of Wisconsin firearms law. Tom has also received his certification as a firearms instructor and participates as a speaker and panelist with the USCCA for live broadcasts, national expos and training videos. He is even serving as a speaker and analyst on numerous TV and radio stations as well as on college and law school campuses.

In this edition of Proving Ground, USCCA employee Spencer is taken from work unexpectedly and dropped into a defensive situation directly from real-life headlines. Concealed Carry Magazine Executive Editor Kevin Michalowski gives him specific instructions to purchase a magazine and a bag of popcorn from a gaming store; he’s in a bit of a hurry.

A return at the counter delays him and distracts other customers as things escalate. Then, a violent, knife-wielding attacker takes a woman hostage!

What does Spencer do when confronted with this scenario? Does he pull his gun, hesitate or simply walk away? What would be the legal aftermath of his decision?

After the encounter, Kevin and USCCA Associate Editor Beth Alcazar break down what went well and what went wrong.

Concealed Carry News: July 17, 2019

Tim Schmidt - 07/17/2019
Friends:

This was a busy week for supporters of the Second Amendment. We continue to see our message — that the ability to defend oneself and one’s family should be encouraged and protected — spread throughout different regions of the country.

Teaching Our Teachers

This Saturday, July 20, is the second annual National Train a Teacher Day (NTATD). Thousands of school teachers and administrators across the country will be offered free self-defense training by certified instructors and training counselors. The USCCA is an official sponsor of this national event, which aims to empower educators across the country with the training and tools they need to defend themselves and others in the case of a criminal attack.

These classes will cover how teachers can defend themselves and students using pepper spray, the proper response to an active shooter and how to survive an active-shooter situation. The classes will also touch on basic trauma and first-aid training. There is also an optional handgun segment that participants can opt to take in addition to the rest of the course.

Gun Regulations Don’t Stop Crime

Rules and regulations have not stopped murderous criminals from committing crimes. But a responsibly armed citizen who happens to be at the scene can and has. Yet our politicians seem to be stuck in a loop, repeatedly having the same conversation. They think that more gun control, more restrictions and less self-protection and freedom will stop evil people from making the conscious decision to harm others.

Most recently, our candidates for the nation’s highest office used the debate stage to announce how they would continue this unproductive cycle.

Check out my most recent op-ed to read more about how the top Democratic candidates for president are part of the closed-minded gun conversation and why they need to welcome different opinions to the discussion.

There are some lawmakers who want to open the gun discussion to include plans on better educating citizens on how to defend themselves.

We at the United States Concealed Carry Association would like to thank the members of the Virginia General Assembly for shutting down the premature, combative special session on guns called by Gov. Northam. This special session was not a session at all but rather a pre-planned attack on the Second Amendment rights of every Virginian. The only laws up for discussion were ones that would have resulted in more restrictions and less protection for citizens of the Commonwealth. Thankfully, the session was shut down in less than 90 minutes (Second Amendment rights safely intacts).

During a meeting of the Committee of the Whole on July 10, Escambia County Commissioner Jeff Bergosh suggested the county allow bus drivers to carry. This came about during a discussion of bus driver safety, in which Escambia County Area Transit management presented on installing protective barriers for drivers.

Senate Bill 1139, which suggests several changes for law-abiding gun owners, has been sent to the governor for consideration. Rep. Nathan Reitz (D – Steeleville) says the legislation would relieve responsible gun owners of certain regulations when applying for a Firearm Owners Identification Card.

Campus Security & Life Safety: New Indiana State Laws: Guns in Church, School Bus Safety, School Alert System

On July 1, 293 new Indiana state laws went into effect, some impacting church and school safety. One such law will allow individuals who are legally authorized to carry a firearm to carry in religious buildings that are connected to schools, so long as the religious institution permits firearms.

Quote of the Week

At a training class for teachers in Utah, special needs educator Sandy Grow said of her decision to arm herself in the classroom:
“The idea of being trapped in a classroom with my students and not being able to protect them bothered me … I want to defend them and keep them safe, not be a sitting duck.” (Associated Press)

Default Kentucky Gun Laws: What You Should Know USCCA - 07/29/2019

Kentucky Gun Laws: What You Should Know

USCCA - 07/29/2019
As a responsibly armed American, you already know how challenging it can be to stay up to date on ever-changing gun laws…

Kentucky gun owners, you’re in luck. We’ve gathered some of the most frequently asked firearms questions in your state. Read on for answers to some of the top questions regarding Kentucky gun laws. (Not from Kentucky? Check the Legal & Second Amendment tab for your state!)

Can Anyone Open Carry in Kentucky?

Yes. Any person who is at least 18 years old and legally entitled to carry a firearm can open carry.

Can You Have a Loaded Gun in Your Car in Kentucky?

Yes, a person may have a concealed and readily accessible handgun in a vehicle with a Kentucky Concealed Carry of Deadly Weapons (CCDW) license or a concealed carry permit from a state that Kentucky honors. Without a permit, persons not prohibited from possessing a firearm may carry a loaded or unloaded firearm in any closed container, compartment or storage space installed as original equipment. This is including, but not limited to, a glove compartment, center console or seat pocket, regardless of whether the container or compartment is locked, unlocked or does not have a locking mechanism.

Is Kentucky a ‘Stand Your Ground’ State?

Yes. Kentucky is a Castle Doctrine state and has a “stand your ground” law. A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat. He or she has the right to stand his or her ground and meet force with force, including deadly force, if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another. Force may also be used to prevent the commission of a felony involving the use of force. Any person who uses a gun in self-defense has immunity from criminal and civil law.

Is It Legal to Conceal Carry Without a Permit in Kentucky? Did the Concealed Carry Law Pass in Kentucky?

Yes. Kentucky is now a constitutional carry state, meaning concealed carry is legal for anyone at least 21 years old who can legally possess a firearm without a license/permit. Those wanting to concealed carry out of state will still need to get a Kentucky Concealed Carry of Deadly Weapons (CCDW) license.

Can You Carry a Gun in a Bar in Kentucky?

You may carry a gun into a restaurant open to the general public with dining facilities available for not less than 50 people and which receives less than 50 percent of its annual receipts from the sale of alcohol. You should also be aware of whether an establishment is posted. Please note: Guns are not allowed in the bar area, just the dining area.

As a responsibly armed American, regardless of the laws in your state, it is unwise to carry while under the influence of any substance that could impair your judgment, slow your reaction times or impact your decision-making abilities. Any decision you make while carrying a firearm could have life-altering consequences.

Do You Have to Register a Gun in Kentucky?

No. No permit is needed to purchase a firearm from a private individual. There is no waiting period and no firearms registration in the state. A background check is required if purchasing a handgun from a Federal Firearms Dealer.

Can You Carry a Gun in Church in Kentucky?

Yes. There is no state statute in Kentucky prohibiting concealed carry in places of worship. However, since places of worship are private property, they may post signs prohibiting firearms.

Default Is It Illegal to Carry a Firearm While Under the Influence? USCCA - 08/03/2019

Is It Illegal to Carry a Firearm While Under the Influence?

USCCA - 08/03/2019

As a responsibly armed American, you might sometimes wonder if you can drink alcohol while you’re carrying your firearm. What does it mean to be under the influence? And how will that affect your self-defense case? Former state prosecutor Tom Grieve will answer those burning questions for you.

When Am I Considered ‘Impaired?’

The level of intoxication can vary by jurisdiction. In some places, a DUI is a .08; in others, it may be a .05. But your level of impairment is going to be different than someone else’s level of impairment. In fact, most states don’t focus on a “legal limit.” Instead, prosecutors will look at if you’re materially impaired (i.e. do you look and act drunk?).

You should also keep in mind that impairment isn’t limited to alcohol or even drugs off of the street. You can be considered intoxicated for something you have a prescription for. You should look into the laws in your jurisdiction to keep yourself out of trouble.
