You Are NOT Going to Want to Miss Our Next Live Training Broadcast...
BY TIM SCHMIDT - USCCA FOUNDER This past Tuesday, I released the first video in the latest Proving Ground series — "Caught Off-Guard at the Camper: Would You Know What to Do if Criminals Approached You?" I can hardly believe this particular video kicks off the 13th scenario-based training series we've released in the past few years. I may be biased, but I personally think Proving Ground has become one of the most valuable tools we provide to the entire USCCA community.

This particular series focuses on travel, camping, RVs and surviving an attack in the great outdoors. (Yup, we do rely on user input to help guide these videos, and "traveling" and "camping" were two that came up again and again.)

Scenario 1, covered in the first video, starts with our trainees enjoying the weather outside their RV when they're caught off-guard by two seemingly friendly fellow campers. It doesn't take long, however, for things to escalate.
Check out the first scenario here, and let me know how you think the trainees did.

I'll be releasing the next video in the series, "Crisis On the Road: How to Prepare Yourself for the Unthinkable When You're Miles From Help," on Monday. This one includes a discussion on first aid and also what might happen if a criminal gets into your camper.

Scenario 2, covered in your third video — "Chaos at the Campground: Discover What Happens When a Vacation in the Woods Turns Into a Vicious Attack" — pits our trainees against a new threat just as they're settling down for the night. (Trust me, you don't want to miss this one!)

One of my favorite things about Proving Ground is how often the trainees do something unexpected. These types of scenarios give all of us in the concealed carry community a chance to really think about potential threats and how we might respond to them. I especially love how many people engage with these videos, ask questions about them and let us know just how much they appreciate the valuable things they learn from them. I hope that includes you!

Default Liberals, leftists, and democrats sue Remington....AGAIN!!!

BY TIM SCHMIDT - USCCA FOUNDER Does any good firearms-related news come out of Connecticut? If what happened this week is any indication, I'd say that's a resounding no.

According to the Washington Post, "Gun-maker Remington can be sued over how it marketed the rifle used to kill 20 children and six educators at Sandy Hook Elementary School in 2012, a divided Connecticut Supreme Court ruled Thursday."

If this story sounds familiar, you're probably recalling how, back in April 2016, Connecticut Superior Court Judge Barbara Bellis ruled to allow the same wrongful death suit to move forward, rejecting the "argument that a 2005 federal law can protect gun businesses from civil lawsuits."

That federal law, the Protection of Lawful Commerce in Arms Act (PLCAA), "protects firearms manufacturers and dealers from being held liable when crimes have been committed with their products. However, both manufacturers and dealers can still be held liable for damages resulting from defective products, breach of contract, criminal misconduct and other actions for which they are directly responsible," GovTrack.us explains.

Families of several children killed in the Newtown attack and one surviving teacher brought the original lawsuit against Remington Arms, parent company of Bushmaster Firearms, who manufactured the weapon — a Bushmaster AR-15 — used by Adam Lanza in the school shooting. According to The Washington Examiner, the basis of the families' suit was that "the military-style gun should have never been available for civilians to purchase."

Although lawyers for Remington Arms sought to dismiss the lawsuit back in 2016, Bellis ruled that Remington's argument "that the federal law shields gun manufacturers from most lawsuits over criminal use of their products ... would be best made in a motion later in the process and [was] not grounds to dismiss the lawsuit."

But it was later dismissed — by the same judge, no less:

According to PBS News Hour, in October 2016, Bellis "granted a motion by the North Carolina-based Remington Arms to dismiss the wrongful death lawsuit brought by the families of nine Sandy Hook victims."

But in a stunning 4-3 decision this past Thursday, as reported in the Washington Post, "justices reinstated a wrongful death lawsuit against Remington filed by a survivor and relatives of nine people killed in the school massacre. The decision overturned a lower court ruling that dismissed the lawsuit, citing a 2005 federal law that shields gun manufacturers from liability in most cases when their products are used in crimes. The majority said that while most of the lawsuit's claims were barred by the federal law, Remington could still be sued for alleged wrongful marketing under Connecticut law."

Nicole Hockley, mother of a 6-year-old boy who died in the shooting, said Thursday that "a main goal of the lawsuit is to stop Remington and other gun makers from gearing their advertising toward troubled young men," the Washington Post reported. "We have always said our case is about reckless sales and marketing to disturbed youth," Hockley said. "We wanted our day in court. This is a step forward to ensure that manufacturers like Remington are not allowed to keep targeting people who are at risk."

I'm not sure how it can be argued that Remington "marketed" its product to Lanza. He wasn't even the one who purchased it.

I stand by previous comments that Sandy Hook was a terrible, terrible tragedy perpetrated by the evil intentions and actions of ONE man. Remington couldn't have known that he would murder his mother and steal her Bushmaster. Insinuating that the company is somehow responsible for the 2012 event is entirely off-base and, in my opinion, irresponsible. It sets a dangerous precedent.

Regardless of the outcome, this is a devastating blow to the firearms industry and — quite frankly — a blatant attempt by anti-gunners to put firearms manufacturers out of business, thus denying millions of responsible Americans their God-given right to keep and bear arms.

I will forever mourn the loss of innocent life at Sandy Hook. But I can't sit back and say nothing when, once again, the fingers are pointed in the wrong direction.

The client was wrongly accused of pulling a sidearm and pointing it at someone. As a responsibly armed American, you already know how challenging it can be to stay up to date on gun laws…Utah gun owners, you’re in luck. We’ve gathered some of the most frequently asked Utah firearms questions. Read on for answers to some of the top questions regarding Utah gun laws. (Not from Utah? Don’t worry, your state is coming soon…)

Can You Have a Loaded Gun in Your Car in Utah?

Yes, a loaded gun is allowed in a vehicle if you have a permit. Without a permit, only an unloaded gun is allowed.

Is Utah a Gun-Friendly State?

That depends on an individual’s point of view. Open carry is legal in Utah with a concealed carry permit. Concealed carry is legal with a Utah Concealed Firearm Permit (CFP) or a permit from another state or county. Utah will honor all other states' permits.Firearms buyers must be at least 18 years old unless accompanied by a parent or guardian, but no permit, background check or firearms registration is required when buying a handgun from a private individual. There are a number of places that are off-limits even with a CFP. These can be found on our Concealed Carry Reciprocity Map & Gun Laws by State website.

Is Utah an Open Carry State?

Open carry is legal with a concealed carry permit. Without a permit, you can only open carry a handgun if it is unloaded and at least two actions from being fired (e.g., rack the slide to chamber, then pull the trigger).

Can You Conceal Carry in Utah Without a Permit?

A permit is required to conceal carry in Utah. Utah honors all other state and county permits.

How Much Is a Concealed Carry Permit in Utah?

A Utah CFP costs $52. This does not include the cost of required training, fingerprinting and photos.

Is Utah a Stand Your Ground State?

Utah is a Castle Doctrine state and has a "stand your ground" law. There is no duty to retreat if a person feels deadly force is justified to prevent a felony from being committed. The law applies in defense of real property or personal property at a person's residence or any place where a person has a legal right to be.

In my March 1st article “On the Road Again?” I discussed travel tips, including the importance of being prepared for vehicular travel to (and through) states beyond your own. I recommended that all armed individuals do some basic preparation before travel.

The Devil Is in the Details

Over the years, I have heard first-hand tales of unfortunate experiences while traveling with firearms. Most of these incidents share a common bond: a lack of awareness of the subtle issues that can create problems.Most states either require concealed carry or allow open carry (with concealment being an option). In others, you need a license or permit to carry concealed, but you can carry openly without one. Each state has its own nuances.The same goes for carry in bars or restaurants where alcohol is served. Some allow carry with no restrictions. Others have downright bizarre rules. Here in Florida, I can carry while seated at a table in a restaurant, but I am breaking the law if I sit at the bar 10 feet away! (Note: Drinking while armed is always a bad idea.)

Reciprocity Tango

Reciprocity refers to one state accepting another state’s license/permit for carry. Step one is to check which states on your itinerary accept your home state’s permit. But what if one or more states do not?To deal with non-reciprocity, many people apply for and receive a non-resident permit from a state that is accepted by the state they expect to visit. Utah is a popular choice because of the large number of states which honor non-resident Utah permits. Several states have recently restricted reciprocity to resident permits only, but as of this writing, 21 states will still honor a non-resident Utah permit.For example, say you live in state “A” and want to carry in state “B” (which does not accept your state’s permit). You can get a non-resident permit from state “C,” which state “B” does honor. However, an increasing number of states have changed their laws and now only accept the permits issued to actual residents of that state.

A Shocking Surprise

This is exactly what happened to “Gary,” a student of mine who lives in state “A,” where he has a permit. He frequently traveled to state “B” to visit relatives, where his home-state permit was not accepted. State “B” accepted permits from state “C,” so Gary got a non-resident permit from “C.”When he originally obtained his non-resident permit from state “C,” it was accepted by state “B.” He enjoyed several uneventful trips to state “B.” But unknown to Gary, state “B” eventually changed its laws to no longer accept non-resident permits.Gary only found out during a traffic stop while on a recent vacation. When he dutifully produced his non-resident permit, the officer asked, “Sir, are you aware that this permit is no longer valid in this state?” Gary’s vacation took a very serious downturn at that point. Remember, laws change. It is our responsibility to stay informed.

Are You TOTALLY Up to Date?

You’d be surprised at the number of people who call me up to renew their permit or license, sheepishly admitting that it had already expired weeks — even months — before! Some of them only discovered their carry permit had expired when they showed it to a police officer!The same goes for things like your vehicle’s license tags, your driver’s license and even your vehicle insurance card. Especially when we are traveling, being current with all of our documentation is simply common sense.

In this week's “Ask a Self-Defense Attorney” video, former state prosecutor turned criminal defense attorney Tom Grieve discusses the responsibly armed American's option of using a public defender for a self-defense case.

Why Should I Hire a Criminal Defense Attorney for a Self-Defense Case? Why Can’t I Just Go With the Public Defender?

As a criminal defense attorney and former state prosecutor, Tom sometimes addresses the following questions: “Why should I hire you? Why should I hire any private criminal bar defense attorney? Why can’t I just go with the public defender?”

The fact of the matter is, criminal defense attorneys are extremely expensive. As a responsible gun owner who owns a firearm for self-defense, you have probably already given some thought to what would happen if you faced a legal battle after a self-defense shooting.

First of all, in order to be eligible to use a public defender, you need to prove that you are legally indigent — one without sufficient income to afford a lawyer for a defense in a criminal case. Many people don't meet that criterion for the jurisdiction they are in.

Beyond the eligibility requirements, there are many other important things to consider. In this week’s video, one of the biggest things that Tom highlights is that a public defender is often handling hundreds of cases at once, so the amount of work that can be put toward any one case is limited.

There's Still Time to Apply for the Linda Harris Memorial Scholarship

In early September 2018, the firearms community lost a legend.

Linda Harris, wife of USCCA friend, Concealed Carry Magazine contributor and SIG Academy co-founder George Harris, passed away at the age of 68.

In a wonderful tribute in her Pacifiers & Peacemakers blog, USCCA Associate Editor Beth Alcazar said, "Undoubtedly, [Linda] was an outstanding instructor who dedicated herself and her career to training people to defend themselves. She was a woman of uncompromising class, integrity, kindness, knowledge and understanding."

Known in the firearms community as an exceptional teacher who encouraged women to get involved in the shooting sports, Linda made waves by becoming the first female firearms instructor in the history of SIG Academy, teaching a variety of firearms-related subjects to men and women alike.

"She was also a valued supporter of the USCCA. And I am so pleased that we have come together as an organization to honor Linda and her accomplishments with the
Linda Harris Memorial Scholarship to encourage, recognize and assist female instructors who wish to expand their education in the field of firearms training," Beth wrote.

The mission of the Linda Harris Memorial Scholarship is to provide a deserving female firearms instructor with assistance in improving her ability to teach . The USCCA will offer one merit-based award annually to a female firearms instructor who wishes to expand her education in the field of firearms training and who shows the knowledge, skills, determination and devotion to firearms education and training exemplified by Linda Harris during her lifetime.

Any currently active female firearms instructor wishing to expand and improve her teaching abilities is eligible for the award.

The winning applicant will be invited to participate in a complimentary USCCA Instructor Certification Course (or another training course offered by the USCCA if she is already a USCCA Certified Instructor) and will receive an all-expenses-paid trip to the annual USCCA Expo to accept her award.

We have extended the deadline for this year's scholarship.

Applications will be accepted through April 19, 2019. (Applications for the 2020 scholarship will be accepted from April 30 to Dec. 1, 2019.)

If you are a female firearms instructor, or if you've had a female firearms instructor who inspired you to protect yourself and your family, I encourage you to apply for (or share information about) the
Linda Harris Memorial Scholarship.

As Beth so eloquently said: "I'm honored to have known Linda. Her legacy is as far-reaching as the many friends and colleagues she influenced during her career. And this scholarship is such an amazing way for the USCCA to recognize Linda's contributions to our industry and to assist female firearms instructors who hope to continue Linda's mission to share safe and responsible firearms ownership with others."
