Cops are judge, jury and executioner over a $150 ticket. But if you're gonna go to court over it the judge is going to ask why you brake checked and then your lawsuit is going to disappear before your very eyes.

Save the aggravation and go back to giving them the finger.

I wonder..if you do brake check, and the guy hits you, and there are witnesses that saw you brake check, would YOU get the ticket? Impeding the flow of traffic?

And everyone talking about suing and getting new cars etc, sounds like most of you have never beenin a lawsuit before. Someone taps your bumper, you tak ehim to court, 4 years later it gets paid for. that was so worth it.

Depends on the cop. A cop can give you a ticket for wiping your ass with the wrong hand. If you don't contest it, you pay it.

Certainly if anyone causes serious injury brake checking they are going to have to answer for it. It won't matter if they were "teaching a tailgater a lesson." In that case, if I had the choice, I would rather be the tailgater than the brake checker.

.... If you hit a guy that brake checked you... Guess what, he isn't getting the ticket... lol... You are... Know why? You were following too close. The way cops and the law look at it... Is if im driving at 50 mph and for some strange reason you don't know.. Completely slam on my brakes.. By law you should be far enough back where you can stop and not hit me. If you do, its YOUR FAULT. Not the guy doing the brake checking. My lawsuit would stand perfectly fine. Know why? Some kid ran across the street... And while I was hurt in my vehicle, he ran away. Prove me wrong. Oh wait, you can't... You think the cops gonna believe you when you say "Well officer I was tailgating him so he brake checked me and I hit him", and then hes gonna turn around and give me the ticket? Bahahaha he will laugh so hard in your face.

For some reason, you seem to think that the cop would believe you when you said I brake checked... Read up Fl. law... 99.9999% of the time you ram into someones bumper, its YOUR FAULT NO MATTER WHAT THE OTHER CAR DID.... The only things this doesnt apply too is someone who pulls in front of you (And even then you need witnesses) or someone doing a U-Turn and pulls in front of you.

But if you are following too close and someone hits their brakes and you hit them... It is 100% your fault. Unless you have some extremely credible witnesses. Hell, all you would have to say was I was avoiding a car in front of me...A car cut in front of me...A kid was about to walk in the street.. A large dog ran across the street...etc... And then the tailgater is guilty. Period.

Uhhh it has happened to me. I bumped into someone when the person I hit actually was the cause of the accident. They were not paying attention to the guy slamming on his brakes in front of him.. He hit the car, came to a stop.. I tapped him. Guess what, even though he caused the initial collision, I was still at fault for hitting him because by Fl. law I was following too close.

Brake checking as discussed in this thread (not emergancy braking to avoid accident but soley to teach the tailgater a lesson) would be the cause of the accident and just about any lawyer could make the case against the brakechecker.

So make sure those witnesses are on your side before you claim some kid ran out in front of you.

That is not what is being discussed in this thread. We are talking about intentionally causing an accident.
