Default Racing on highway ticket (Yes I KNOW!!!)

ok I know there is already a thread but I have a slightly diffrent angle.

It happend lastnight in New Port Richey. Only thing is I wasnt racing!!!!! I have no idea what the state tropper was talking about. When he turned his light on I moved from left lane and heard a horn blair and saw a camaro go blowing by me.

So when I pulled into a parkign lot he told me he cloked me speeding and then said I was racing. I said "Racing? Who?" he proceded to tell me hes not dumb and why would two cars be speeding at the same time. I again told him "Officer I wasnt racing. I didint know anyone was near me".

He went to his car and came back with a speeding ticket and racing on highway. He asked if I had any comments I again said "I was not racing anyone", he just said have a nice night...


So I called a lawyer today and they want 765.00 to goto court, but then he tells me I may have to serve jail time. WTF???? MY driving record is clean except for one speeding ticket (56 in a 50) and I have to goto jail because some cop said I was racing. I will admit I was speeding but for god sake I WAS NOT RACING.

What the hell can I do? I dont want to be raped!!! It just seems rediculious that because some car paces me then almost hits me when I pull over (mind you he didint go after that guy) that I may have to goto jail..


Any positive advice would be appreciated. Please none of the get your fuckign KY jokes.. This is pretty serious for me. If I goto jail I will loose my job thus not be able to pay my mortgage or goto school and thus completly fuckign my life up because I was speeding at 11:30pm on a wednesday.

I just dealt with one of these tickets.

Here's my experience, though I think the rules have changed since then. (November 2005)

Paid lawyer $800, charge was dropped to Wreckless Driving which was then waived since the Defensive Driving Course was taken. It was in Pinellas County. Richard Alexander out of Duniden took the case. You might want to look him up and just ask for some advice.

I've heard about the jail time before, yet I've never seen it happen.

Someone @ the shop got one, too...they went to court for their pre-hearing & the judge told him "You'll most likely get a $200 fine and 1 year license suspension."

That's better than jail time, IMO.

thanks guys for the input. I am nerviosu as hell and stll have like 3 months till I hear anythign from lawyer... Just told my girlfriend and she said "if you goto jail I cant date you"... real fucking supportive.

i want to call your girlfriend derogatory names right now.

You need to find a lawyer that will win your case and afterwards sue for damages done (legal fee's). It is the prosecutions responsibility to prove their case and since you weren't racing, there is no video footage or witnesses, how can they possibly do that?

This is the kinda shit that pisses me off. I feel for ya man, you really got shafted today. Take some good time finding the right attorney. I would also file a complaint against the officer in question ASAP, and persue his ass legally if at all possible. I mean I'm going after someones badge if they try to ruin my life on a whim like that.

What was the speed limit and how fast were you going? I think cops need to open their eyes and see what actually "street racing" is. Just because you see a car with aftermarket parts doesn't mean you should accuse them of something they actually didn't do. Its like, your at a red light and light turns green... you leave off the light like you do every light but the car next to you does the same and front bumper is probably at your fender and cops says oh you were racing. Its bs for real. Usually in a street race they'll both vehicles over... or atleast try to. Seems he didn't even bother with the other car. You might be able to question that... how come your getting a ticket for racing and if you were actually racing how come the other vehicle wasn't pulled over.

Back in 2002 in Orlando, I got pulled over... supposely I was speeding when I was actually doing 45 in a 45 zone. Their was a BMW on the left lane and had probably 2 car lengths ahead of me and continued to inch farther... I was on the right lane. I get pulled over and cop tells me I was doing 65 in a 45. I didn't question it because usually a speeding ticket would be hard to fight. But in that example you see a cop "choosing" a car that was not actually breaking the law and pin pointing it on that car. I had a body kit, exhaust, etc.

It was US 19 just south of Gulf View mall. Near catches...

I was doing 70 is 45... Yeah I know... But first off I had no idea 19 was even 45mph... and I will admit I was speeding.. I was in a hurry to get home and get to bed for work.

That sucks man.. atelast you didnt get busted by a NPR or a PR cop.. ask Mike on the board about me and him getting harrased by pr cops.. they are extremly agro...
