THe 1mph over I would fight...They wonder why no one respects them

back on topic. i was three houses down from my house.
but damn one mile over. that is shitty. i actually believe they can ticket you for 1 mph over the posted speed limit . i will have to check out the florida state staues book in a few minutes.

Both shitty situations.

Sl2racer, I cought some flak a while back for riding with my visor up.
FYI, Helmet or not, you are required to have eye protection on while the bike is moving. The cop was a dick for actually writing the ticket though when you were that close to home.

Man, I normally jump into these posts because it's always some kid whining about getting caught doing something wrong, but that's just straight up asshole of the cop. I'm sure he could tell by your ID that you were 3 houses away from yours, and by the grease you were obviously working on the bike. I think that guy just had a hard on for ticketing a biker that day.

Don't take it to court though. Lawyer charges and court costs are going to be more than $70, so just pay the ticket.

yea i do know that i need eye protection at all times. i know that technically i was in the wrong but given the circumstance i did not feel i deserved the ticket since i was odviously working on the bike and riding slower than one of those weedwacker powered scooters. no helmet because i wanted to hear if any noises were coming from the clutch area.

yes he clearly knew my house was only three houses down (which insidently was about 200 ft away) and was working on the bike. i will not be taking it to court because i don't need any other kind of problems or more money to have to pay toward it. i technically was in the wrong but what a dick for writing me the ticket given the situation.

i tend to agree with not taking it to court because its a non points ticket.

but if you don't and its on your record, the judge will see it next time your in there for something like speeding. he won't know its a bullshit ticket and it may just add to you as a history of breaking the law type of thing.


i think i would at least go in and talk to your lawyer about it. my end up costing you a little more now but end up being better in the long run if he can get it dropped altogether.


oh yeah and just so you know. if you get 15 tickets in 5 years for anything you are considered a habitual offender and thats a whole other world where little shit like this could mean jail time. so take care of yourself out there.

guess i better slow down then i think i am sitting at 10 tickets. my driving record is like a novel so i don't think this will be that bad in there. actually compared to the rest it will look like i was being an angel for once.

??? on a different note can you farther explain this 15 tickets in 5 years or provide a link? i have never seen that in the letter i recieve from tallahasse/dmv that states i am in danger of losing my liscence again.

i had to set thur a 12 course a while ago and they brought it up. i'm sure its out there somewhere i just never looked it up. seemed like a really big deal to the 3 people that were there and on it.

322.264 "Habitual traffic offender" defined.--A "habitual traffic offender" is any person whose record, as maintained by the Department of Highway Safety and Motor Vehicles, shows that such person has accumulated the specified number of convictions for offenses described in subsection (1) or subsection (2) within a 5-year period:

(2) Fifteen convictions for moving traffic offenses for which points may be assessed as set forth in s. 322.27, including those offenses in subsection (1).

Any violation of any federal law, any law of another state or country, or any valid ordinance of a municipality or county of another state similar to a statutory prohibition specified in subsection (1) or subsection (2) shall be counted as a violation of such prohibition. In computing the number of convictions, all convictions during the 5 years previous to July 1, 1972, will be used, provided at least one conviction occurs after that date. The fact that previous convictions may have resulted in suspension, revocation, or disqualification under another section does not exempt them from being used for suspension or revocation under this section as a habitual offender.


i see 12 and 15 in five years. and looks like you only need 3 major ones.so i would check into it. your way to close. not sure if I'm reading it right or not but in the class they said any ticket. even non point ones
