Mark Houck, a pro-life advocate and father of seven, woke up Friday morning to a team of FBI agents raiding his home in Kintnersville, Pennsylvania. Houck’s wife, Ryan-Marie, told Life Site News that 25-30 FBI agents entered their home around 7 a.m.

“The kids were all just screaming. It was all just very scary and traumatic,” Ryan-Marie Houck told Life Site News about her husband’s arrest, which she and her children witnessed. She says her husband pleaded with the FBI agents to be calm, referencing the couple’s seven children.

“They had big, huge rifles pointed at Mark and pointed at me and kind of pointed throughout the house,” Ryan-Marie Houck told the pro-life news outlet.

Catholic News Agency reports that the FBI confirmed that Mark Houck was arrested outside his home “without incident” Friday morning.

According to federal court documents, Houck was arrested on the charge that he assaulted a mystery 72-year-old volunteer, whose name is not provided, at the Planned Parenthood Elizabeth Blackwell Health Center abortion clinic in Philadelphia, Pennsylvania, twice on Oct. 13, 2021.

The District Court in Philadelphia investigated and dismissed the charge earlier this summer, Houck’s wife, Ryan-Marie, told Life Site News. She said that her husband sometimes brought their eldest son with him. She added that on multiple occasions that a “pro-abortion protester” would say “crude … inappropriate and disgusting things” to their 12-year-old son, such as “your dad’s a fag” and other vulgar slurs.

Her husband repeatedly told the man to stop verbally harassing his son, Ryan-Marie Houck explained. But the man didn’t stop. On one occasion, the man “kind of came into [the son’s] personal space,” Ryan-Marie Houck said. “Mark shoved him away from his child, and the guy fell back… He didn’t have any injuries or anything, but he tried to sue Mark.”

Brian Middleton, a friend of the Houck family, told The Daily Signal that “[Mark] was defending his son from a man who was verbally abusing his son. He stepped between them and asked him to stop. The man continued to lean in and verbally abuse. Mark extended his arms to get the assailant away from his so.” Middleton added: “Mark will not be available until further notice under advice of counsel.”

State Sen. Doug Mastriano, who is the Republican candidate for governor in Pennsylvania, released a statement following Houck’s arrest. “The continued weaponization of the FBI and persecution by Joe Biden’s DOJ against ordinary Americans is an outrage,” Mastriano wrote, adding:
This morning, a heavily armed SWAT team of dozens of FBI agents raided the home of Mark Houck of Bucks County, Pennsylvania, with his wife and terrified children inside over a case that was long thrown out by the District Court in Philadelphia. Mark and Ryan-Marie Houck’s seven children were traumatized and in tears as they witnessed their parents held at gunpoint and their father hauled away in handcuffs.


After his Friday arrest, Houck appeared before the U.S. Eastern District Court in Pennsylvania. He was indicted for violating the Freedom of Access to Clinic Entrances (FACE) Act, which “makes it a federal crime to use force with the intent to injure, intimidate, and interfere with anyone because that person is a provider of reproductive health care,” the Eastern District of Pennsylvania U.S. Attorney’s Office wrote in a Friday press release.

Authorities released Houck later that day, but he now faces felony charges. If convicted, Houck could have up to an 11-year prison sentence, and fines of up to $350,000.

Borrower Sues to Stop Biden’s Unfair, Illegal Student Loan Bailout

Probably the most common legal argument against the Biden administration’s student loan bailout plan is that the federal Department of Education simply doesn’t have the authority to accomplish it.

That’s a core argument in a new lawsuit filed by the Pacific Legal Foundation on behalf of an employee whose student debt is affected by the bailout plan.

Putting aside the issues of unfairness, the legal arguments have always been persuasive. The challenge has been to find a plaintiff who will suffer a legally recognized injury necessary to get into court.

The Pacific Legal Foundation has found a whole group of plaintiffs.

The organization’s client, Frank Garrison, has been paying down his education debt using Public Service Loan Forgiveness, a program that will forgive his remaining debt after he makes 120 qualifying payments. He’s about halfway through. He also is using the Income-Driven Repayment program, which caps his monthly payment based on his discretionary income.

Various problems with such federal programs and loan forgiveness in general have been described elsewhere, but here these programs mean that Garrison would have had his loan balance zeroed out after about 60 more months, with modest payments along the way.

Now, the loan bailout would automatically cancel $20,000 of Garrison’s debt instead, subjecting him to Indiana’s income tax, while doing nothing to improve his monthly payment due to his Income-Driven Repayment participation. He will owe about $1,000 to Indiana simply because the U.S. Department of Education is changing the rules.

Since several states treat loan forgiveness the same way, there are people across all of those states in the same boat. There are probably a lot of borrowers, among the 8 million qualifying Public Service Loan Forgiveness borrowers nationwide, who also are using the Income-Driven Repayment program in these states.

That’s enough for Garrison and the others to get into court. The key point of the HEROES Act is that borrowers “are not placed in a worse position financially” in relation to their student loans because of a war or other national emergency, but the Department of Education is causing, not remedying, economic harm to people like Garrison.

That means several additional arguments get into court, too:

• The HEROES Act, on which the Department of Education is relying for the bailout, violates the constitutional principle of separation of powers, as well as the nondelegation doctrine. That means that Congress cannot give away its legislative power to the executive branch. The law purports to give the secretary of education the power to modify or amend the law regarding repayment requirements, subject only to the conditions in the rest of the HEROES Act, violating those core constitutional principles.

• Even if the HEROES Act were constitutional, it does not give the Department of Education the power to cancel repayment of student loans in this case. For one thing, the HEROES Act requires that the cancellation be “necessary” and targeted to economic harm that is “a direct result of a … national emergency.” But it’s not. Student loan borrowers are not, the plaintiff quite reasonably claims (quoting the law), “directly ‘affected individuals’ who ‘suffered direct economic hardship as a direct result of a war or other military operation or national emergency.’” And mass cancellation of debts is “hardly ‘necessary’ to mitigate the economic harms of the pandemic.”

• The Department of Education’s sweeping decision includes many people who are not any worse off because of the pandemic (and probably a lot who are better off, depending what companies they work for). And for those who are worse off today than when the pandemic emergency was declared years ago, they may not be any worse off “relative to their federal student loans” or due in any way to the pandemic in the first place.

• Even if the HEROES Act were not only constitutional but also able to sweep in such a variety of borrowers, the cancellation is so economically and politically significant that it violates the “major questions doctrine.” The U.S. Supreme Court has been using this doctrine recently in, for example, West Virginia v. EPA, which stopped the Environmental Protection Agency from (improperly) discovering a huge regulatory power in an ancillary part of environmental law.

The Department of Education is making the same error here.

“The major questions doctrine,” the plaintiff notes, “requires a clear authorization by Congress of such an economically and politically significant action, which is lacking here. … Without a valid source of authority, the Secretary [of Education] ‘literally has no power to act’” (quoting a different case).

Congress gave no clue that hundreds of billions of dollars in a massive loan bailout was in the HEROES Act, because it isn’t.

Overall, the HEROES Act was never meant for massive cancellation of the obligation to pay back student loans. Furthermore, the bailout plan’s income cutoffs, its relief amounts unconnected to the pandemic emergency, and its arbitrary provision to double the relief amount if the borrower had ever received a Pell Grant (even decades ago), as I have written elsewhere, further show the Department of Education’s abuse of power—if it was properly delegated any such power in the first place.

6 Important Issues at Stake in Appropriations Bills

The government’s fiscal year begins Oct. 1, but as per usual, Congress has failed to complete the annual appropriations process to provide spending authority for federal agencies.

Congress will enact a continuing resolution to maintain current spending and policy, and to prevent a partial government shutdown of nonessential programs, but Americans concerned about inflation should hope that resolution extends into the new year and the new Congress.

President Joe Biden has asked for tens of billions in irresponsible additional spending and controversial policy anomalies to be attached to this last legislative vehicle leaving the station prior to the November elections, but most of these will be rejected.

The real question is what happens next.

Biden, House Speaker Nancy Pelosi, and Senate Majority Leader Chuck Schumer will push for a big spending package in the lame-duck period after the election. That would lock in a third year of a liberal policy and inflationary spending agenda, rammed through by unaccountable members of Congress, many of whom will have been voted out of office.

Lawmakers should not rush through a massive omnibus appropriations bill that spends too much on all the wrong things, especially in a lame-duck Congress.

Instead, the new majorities in the next Congress should take the pen and enact responsible spending bills that advance the policy priorities of the American people. That will only happen if the continuing resolution extends into at least January.

Here are six issues that are at stake in these appropriations bills:

1. Inflation and Government Spending

Inflation has hit rates not seen in four decades, thanks to excessive government spending with the Federal Reserve as an enabler. With the economy shrinking in the first half of this year, America has entered a period of stagflation, thanks to the government’s harmful policies.

The average worker has seen their inflation-adjusted income fall by $3,000 since January 2021. It is no wonder that inflation and the economy consistently rank as top issues on the minds of Americans this fall.

A massive appropriations bill that further increases government spending would add to inflationary pressures. Such a spending package should be unconscionable in this economic climate.

The most helpful thing Congress could do to turn the tide of inflation is to begin reducing spending. Simply put, the appropriations bills must spend less than the status quo, and should at least go back to the pre-pandemic spending levels.

 

2. Border Security

Biden’s open borders policy has been a dereliction of duty to his responsibility to keep America safe. His policy has also hurt migrants, especially children, as their parents are enticed to send their children unaccompanied across the border because they get to remain in the U.S. and receive immigration benefits. A historic 272,745 unaccompanied alien children have crossed the border since Biden took office.

Rather than funding border security measures to address the crisis and these inhumane conditions, the continuing resolution would give another nearly $1.8 billion to the Department of Health and Human Services’ Administration for Children and Families “Refugee and Entrant Assistance.”

This will continue to fund the administration’s and nongovernmental organizations’ illegal alien smuggling and transportation operations in and throughout the U.S., resulting in even more unaccompanied alien children crossing the border and becoming sex-trafficking victims. No one should be funding this.

House Minority Leader Kevin McCarthy, R-Calif., that if this government funding bill does not “address the border crisis immediately,” he will oppose it and urge his GOP colleagues to as well.

Rather than give Biden the blank check he requested to fund more illegal immigration, Congress should use the appropriations bills to advance real solutions to secure the border.

The totally misnamed “Inflation Reduction Act” established an $80 billion slush fund for the Internal Revenue Service. This will add 87,000 new agents, doubling the size of the agency. This new spending comes on top of the nearly $13 billion provided annually to the IRS in the regular appropriations bills.

3. IRS Overreach

The new agents and new funding could be used to subject small businesses and middle-class taxpayers to more IRS scrutiny. This is concerning because the IRS is a scandal-ridden agency with a history of targeting the regime’s political opponents.

Congress should rescind the IRS slush fund as a part of any full year appropriations bill. Lawmakers should also use the spending bills to conduct rigorous oversight of the IRS and require strong taxpayer protections as a condition of annual funding.

4. Student Loan Debt Amnesty

Biden’s student loan debt amnesty is expensive, unfair, and potentially illegal. It could cost taxpayers up to $1 trillion, according to estimates from the Penn Wharton Budget Model.

The annual appropriations bills provide office of student aid administration more than $1 billion in taxpayer funds to administer student loan servicing activities. The appropriations bills should prohibit the Department of Education from using funds to carry out Biden’s debt amnesty.

5. Rein in Executive Overreach

The Biden administration has begun a regulatory blitz, with more than 2,600 active regulatory actions, including 200 economically significant rules that are estimated to have an annual effect on the economy of $100 million or more.

Biden’s executive actions could also cost taxpayers up to $1.5 trillion—so far.

Congress should put a stop to the administrative state and rein in this executive overreach using its power of the purse. Lawmakers can prohibit the use of funds to enforce finalized harmful regulations or to carry out pending regulatory actions. Congress can also use the spending bills to provide oversight and require accountability from the executive branch.

6. Protecting Life

At the beginning of the 117th Congress, 200 representatives and 48 senators took a stand that they would oppose any funding bill that weakened long-standing pro-life provisions.

Not only have congressional liberals proposed gutting protections such as the Hyde Amendment that prohibits federal funds from being spent on abortions, they have advanced a radical pro-abortion agenda that is extreme and out of step with what most Americans across the political spectrum believe.

Planned Parenthood’s most recent annual report shows the organization performed 383,460 abortions in fiscal year 2020 while receiving more than $663 million in taxpayer funding. That is an injustice that must not continue.

Not a single penny of the taxpayers’ dollars should go to the abortion industry. Lawmakers should ensure the appropriations bills protect life.

These are just a few examples of the important policy issues that could be affected by the fiscal year 2023 appropriations process. The 12 annual spending bills cover hundreds of programs and virtually every subject that the federal government touches.

Instead of a lame-duck liberal spending binge, the next Congress should carefully write responsible appropriations bills. The Heritage Foundation’s Budget Blueprint includes more than 100 different policy recommendations for discretionary spending programs.

Lawmakers should go on offense and deliver policy victories for the American people by passing sensible spending bills in the next Congress.

Florida Gov. Ron DeSantis has done it again.

In using already-appropriated government funds to fly 48 illegal alien Venezuelan migrants from San Antonio, Texas, to the tony blue enclave of Martha’s Vineyard, Massachusetts, DeSantis has once again demonstrated his mastery of the political game.

For at least the second time this year, with the first being his bringing The Walt Disney Co. to heel when that company badly erred and picked an unwinnable fight over gender ideology, DeSantis has highlighted for all his sound judgment, shrewd political instincts, and ability to frame the national political narrative to his liking.

The situation at America’s southern border is nigh catastrophic. As of earlier this week, in fiscal year 2022, the Border Patrol has encountered more than 2.4 million illegal aliens. That is substantially higher than the previous record, set—you guessed it—just last fiscal year, when the Border Patrol encountered a little under 2 million illegal aliens. Fiscal year 2022, incidentally, isn’t even over.

Prominent border towns such as Del Rio, Texas; Eagle Pass, Texas; and Yuma, Arizona have been completely besieged by the murderous, transnational criminal cartels that now de facto control the U.S.-Mexico border. Those cartels are taking advantage of the Biden administration’s gross negligence, flooding the border with unvetted migrants and the de facto chemical warfare that is (usually Chinese-manufactured) fentanyl.

In countless border towns across the four states sharing a land border with Mexico, crime is now rampant, migrant facilities are overfilled to the point of inhumaneness, and basic social services, such as hospitals and medical facilities, are completely overtaxed. Biden says So What?, We won didn't we? WE can do anything we want to and you can't do anything about it!

Nor, while the problem is most acute in states such as Texas and Arizona, is the issue narrowly confined to border states. Due to the Biden administration’s reckless resuscitation of Obama-era “catch and release” policies, countless masses of illegal aliens crossing the border and pleading invariably bogus “refugee” or “asylum” status are also being shipped to the nation’s interior so that democrtas can register them and outnumber the republican voters.. They will purportedly one day stand before our overloaded immigration courts to formally press their claims, but in reality they will usually just escape into the shadows, never to be heard from again.

Amid this horrific status quo, and Biden’s gross dereliction of his solemn duty to secure the border, what exactly is the sane half of America that actually wants a secure border supposed to do?

Beseeching the administration to stanch the bleeding has simply not worked, so hard-headed action is needed. Such a state-level urge to secure itself against unwanted intruders is entirely justified, both morally and constitutionally; as the late Supreme Court Justice Antonin Scalia reminded us in the 2012 case of Arizona v. U.S., “the power to exclude from the sovereign’s territory people who have no right to be there” is the “defining characteristic of sovereignty.”

Thus began Texas Gov. Greg Abbott’s prolonged busing campaign, which has been months ongoing, to ship hundreds of illegal aliens from the Lone Star State to blue, “sanctuary” jurisdictions such as Chicago, Washington, D.C., and New York City.

The idea was simple: Make these sanctimonious elites, who are incentivizing a genuine humanitarian disaster with their open-borders policies and obtuse rhetoric, feel at least a modicum of border states’ day-to-day pain. But Abbott’s efforts, however warranted, didn’t seem to have a huge effect on the national discourse.

Enter Ron DeSantis.

The Florida governor’s move, for which he is risibly already being investigated and sued, has successfully shone a massive spotlight on America’s immigration mess. It has dominated headlines for a full week now, garnering mass plaudits from those on the right and performative shrieks of hysteria from those on the open-borders left.

By choosing Martha’s Vineyard, the iconic liberal elitist bastion and summer home of former President Barack Obama, the Republican governor stuck a dagger deep into the heart of the American liberal psyche. Better yet, he highlighted the unbearable hypocrisy and “NIMBY”-ism of liberal democrat elites—those contemptible yuppies who would publicly clamor for unfettered migration while privately bewailing the fact that their resort town must now bear the burden of a mere 48 aliens.

DeSantis thus forced a national conversation on the unsustainable, egregious situation at America’s southern border. And in so doing, he cleverly guided the conversation to political turf that redounds, in the lead-up to the pivotal 2022 midterm elections, to Republicans’ benefit.

As Axios reported Thursday morning: “Stories about the busing and flying of migrants to other parts of the country captured significant social media attention over the past week.” The outlet continued: “Interactions on stories about DeSantis flying migrants to Martha’s Vineyard far outnumbered those on the stories about abortion or the FBI raid at Mar-a-Lago during that same time period, for example.”

Considering that there is some evidence that abortion is hurting Republicans in certain swing states—a problem greatly exacerbated by Republicans’ own perpetual fumbling of the issue—this is a welcome political development. Public polling routinely show voters trust Republicans more than Democrats on immigration and border security. And who can blame them?

Formally, Ron DeSantis may be the governor of just one of America’s 50 states, but over the past two years he has also emerged as the singular focal point and symbolic leader of red-state America. As DeSantis has again reminded us, his instincts for picking smart and culturally salient fights, on winning and meaningful issues, is unrivaled in American politics today.

Those of us who live in Florida are deeply fortunate to have him as our leader. Would that the rest of America one day gets to experience it, too.

The Radical Left is using the power of the administrative state to execute their unpopular agenda and further centralize power in Washington. And now they are using federal agencies as their own secret police to punish any and all opposition.

When the Biden Administration falsely accused our brave horseback border patrol of “whipping illegal aliens”in Del Rio, Texas we instantly knew it was a crock of horse manure. Democrats always lie. Always. We filed a FOIA request to see what Secretary Mayorkas knew before he went to the American people and threw his own employees under the bus. He went as far to say that images of the incident “painfully conjured up the worst elements of our nation's ongoing battle against systemic racism.”

Well, many months after a FOIA investigation and having to sue for records, we got an answer: his own top press staffer told him hours before his infamous press conference that there was no whipping.

Instead of standing up for his agents, Secretary Mayorkas threw them under the bus—and now we know he withheld critical information that would have cleared his agents.

A lot of the country moved on from this incident…but we didn’t. The men and women of the Border Patrol deserved better. And based on our discovery,the Border Patrol Union, for the first time in their history, called on the Secretary of Homeland Security to resign.

This shocking email revelation was covered all day on Fox News and other networks and received the attention of dozens of lawmakers in Washington. Most of them added to the chorus that it was time for Mayorkas to resign or be impeached.

This is just one of the strategic lawsuits we’ve filed that is already holding the Biden administration accountable. And we’re just getting started.   

In fact, we’ve filed over 300 FOIAs and are litigating on 10 as of now. We need that number to increase, dramatically, so we can get information out in time for Congress to act.

As you may have heard, The Heritage Foundation is leading a major initiative called the 2025 Presidential Transition Project. We're already at work to give the next White House the policy recommendations and vetted personnel that it will need.

My office is right next to Paul Dans, who serves Heritage as the director of the 2025 Project. Since I have a front row seat to everything he's working on, I want to directly share some recent highlights with you.

This Tuesday, Paul and his team hosted a working group with the 40 coalition partners who are contributing to Project 2025. Far from being a solo effort by Heritage, we have the best minds from the entire conservative movement coming together to set up the next administration for success.

Part of the effort is teeing up the most important policies that the new White House should enact in its first 180 days. Heritage is coordinating 400+ authors to write a new version of our well-known "Mandate for Leadership,” which will set a vision for conservative policy in America.

One of those experts authoring the Mandate is Rick Dearborn, who was just announced as a Heritage visiting fellow. All that said, you and I know that the right policy ideas will only succeed with the right staffers filling the White House. Another part of the Heritage plan is to build a database of 10,000 vetted and trained personnel who are ready to serve the incoming administration.
