so last week i was rear ended. not a bad accident at all. i was in my 94 eg hatch. it was his fault and was cited for following too close. now the damage was only to my tailgate(dented it and where the hinges attach to the frame in a lil). and my bumper needs to be straightened out(no biggie). now i got it appraised and it would be $690 dollars to fix.

now there were no injuries, and no lost wages because my car is still drivable.
so i know i wont be compensated for those but will i be compensated for the pure stress and inconvenience of this whole situation? id also like to hear from someone whose been in this exact situation.

how would i make out pretty good already? by wasting my time the night i got hit, my time dealing with the insurance company, my time going to get the damage appraised, the what would be leaving my car to get it put back to the way it was before i got hit.... with nothing but wasted time and all this frustration to show for it... ?

oh and btw, im not greedy and out to get rich, but ive been rear ended before(way worse) and i got screwed...

 

You got $700 for some battle wounds on a 15 year old civic. Just take that money and be grateful no one was hurt.

i work for an insurance company.
the company is supposed to make you whole again.
so in this case you will get your car fixed and a rental while it is being fixed.
i do not know you age so if you are to young or do not need a rental ask for loss of use while it is the shop.

in regards to your injuries or the lack thereof. If you did not treat or go to the hospital you may end up with $500 just to settle. Just tell them you bumped your head or got a cut or something and will not get a lawyer.

hmm well im 20, ill be 21 the 17th but i do believe you have to be 24 to rent a car... so ill ask for loss of use and they know there were no injuries already(ive done my statement for them). but i will def let them know getting a lawyer is on my mind. thank you jewbu

 

I would just be happy that they will pay to fix your car. They could have denied your claim forcing you to use your insurance to fix it and fight in court for reimbursement all while increasing your montlh insurance premiums because the claim is on you. Just because he was cited by te police does not constitute guilt in the eyes of the insurance company. They can force you to prove it. Been on both side of that situation.

And you can get a rental under 24/25 what ever it is. My fiance did last year.

 

he said everyones insurance. yours, mine.. everyones. thats how they pay for it. upping his a little will happen either way.


and when dealing with insurance. it would help if you had a job and could show loss of wages. i mean if you don't even work. why is your time worth so much money? its not. you didn't miss out on anything worth while. and my guess would be doing different car shit anyways.



no one ever wins when insurance is involved. like graves said. be glad they didn't make you prove it. all the other guy had to say we you slowed for some reason and he feels it was your fault. and then you wouldn't have got a dime out of them. so even thou he hit you, be glad he wasn't a total dick. almost 2 years and 6k worth of car repairs later and mine still hasn't been to court. and the damn lady ran the redlight.

you can call your insurance company and tell them you arnt' happy with how the other side is handling your claim. but it prob won't do much.

 

just so its clear im going through his insurance company. mine has not and probably will not be notified. his company said its pretty much was a done deal as far as them excepting liability... so i dont see my insurance getting involved. that means if my insurance doesnt get involved then my rate doesnt go up, same as last time i got rear ended. Also i do have a job, but since my car is drivable im not missing work, hence the no lost wages... and im 20 so im too young to get a rental...


so back to my main question. so no one thinks i should be compensated for my time, loss of use while in the shop, and the stress of dealing with all this bull shit?....
