pls help speeding ticket
has anyone in here got a moving violation for speeding cuz the pig couldnt clock them or pace them so by looking he guessed i was speeding will this bullshit of a ticket hold up in court if i fight it?
the statute number is section 3/6.07 and sub section 4 thats what he wrote ...... he was sitting in a parking lot i made a u turn about a block down from him heading w towards him and i maybe got up to 50-55 tops but he told me i was doinf 75 which is impossible i think .... i think he just heard my exhaust his gave himn the idea that i was on the gas cuz its loud.

316.074 Obedience to and required traffic control devices.--
(1) The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto, placed in accordance with the provisions of this chapter, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this chapter.
(2) No person shall drive any vehicle from a roadway to another roadway to avoid obeying the indicated traffic control indicated by such traffic control device.
(3) No provision of this chapter for which official traffic control devices are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official device is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that official traffic control devices are required, such section shall be effective even though no devices are erected or in place.
(4) Whenever official traffic control devices are placed in position approximately conforming to the requirements of this chapter, such devices shall be presumed to have been so placed by the official act or direction of lawful authority unless the contrary shall be established by competent evidence.
(5) Any official traffic control device placed pursuant to the provisions of this chapter and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this chapter unless the contrary shall be established by competent evidence.

after reading the statue it looks like he wrote you up for being a traffic control device that approximately conforms to an authorized device. WTF I'd say go to court with a print out of the statute and ask the judge what it was that you got a ticket for? if he was trying to say you weren't obeying the speed limit sign (since it is a traffic control device) you need to know what certifed tool he used to determine you were speeding. also if you were the only car in the immediate area then he can't compare your speed to the surrounding traffic. Also find out (actually go back to the location and measure) the distance from the spot you did the u-turn to where he was sitting. Then post on here or find out who can help you with the math of taking the vehicle weight, distance traveled, and both the speed limit and the speed he said you were going. you are basically going to find out the acceleration needed to get up to that speed in the distance traveled, then use the acceleration to figure with the weight of the car to see how much force you need to accomplish that, then convert that force into hp/tq, do that with both speeds, if you were driving heavy footed the math should prove that your car is too weak to do what the cop is claiming. Don't bring all this out in court unless it is looking like the judge is going to side with the cop. If the math doesn't work, throw away the answer. Also if the cop wrote/checked off speeding and then wrote the statute for the traffic control device he wrote the wrong statute and yo should be in the clear for that.
^^read, he says he wasn't speeding. It'd be different if he said he was speeding but wanted to get out of it on a technicality. what your saying is when a cop arrests you for smoking pot but you weren't and a piss test proves it, it's still your fault don't blame the dumb cop for being a dick. could he be lying about not speeding, sure, but taking it on face value and assuming what he is saying is true, help him out. next time it may be you getting this cop and being written up for a modified exhaust when you know it is stock, except for the big autozone tip that you bolted on.
