there is no his side. He told me before it was perfect and its not..point made...id rather keep it quiet about his name right now.

First of all, everyone is correct on the legalities, but you don't have enough damages to pull a lawyer away from a sushi bar. Obviously, this should never get to court, but if it does, it should be small claims court and you can easily represent yourself. You have plenty of evidence, so make sure you print all those messages.

Post the guy up if he doesn't respond to an ultimatum. You don't want someone else on the board to get screwed if he has more shit for sale.

It would also be helpful to get a certified mechanic to look at it, verify its condition, and give you an estimate for repairs... whether you intend to repair it or not. This will help establish the dollar amount of your damages.

You will lose in court without paperwork, nomatter what the law boy says, as a last ditch chance, are you sure your clutch is properly adjusted, a dragging clutch will produce all of the same symptoms.

also clutch is adjusted fine...It changes into 4th fine if you shift fast or at high revs. i have done many of them already...its also hydraulic so theres not much adjustment not like a cable tranny.
