So i was involved in an accident today where the guy said "he didn't see me comeing" so basically he pulled out infront of my while i was going through the intersection at 41 and 52. I was slowing down just because of all the traffic but went through the intersection at a good 40-45 MPH. I did all i could not to hit him and i just caught his rear bumper, quarter panel which was pretty messed up on his truck(ram 1500).

He told me to pull down the street after the crowd left us. Which i did while probably still in shock but followed him. I then exchanged information and tryed to make it to my house. I only made it maybe 3 miles before the Oil cooler lines busted and oil was leaking on my knee/leg (the one that dented his bumper) so i pull over and called my uncles for a lift.


My question is What should by my next step? Suck it up and just fix the bike Or take legal action? I don't have insurance on my bike should i put it on there then file a claim? I don't have an Endorsement either. Would a Lawyer be a bad decision?

The front of my bike is in pieces and my knee is about 2 1/2 sizes bigger then the other besides that Im Still breathing but my bike is pretty undriveable.

 

well your not at fault. florida is a no fault state so im assuming your gonna have to call your own insurance agency first assuming you have a car with insurance on it. if not call his. report what happend and thier gonna send someone to look at the damages. most times they make you pay the deductable but if you know a guy who runs a shop he can up the price of the damages that will take care of the deductable. you also need to go to the hospital and get the knee checked out. go with your own insurance info cuz the insurance companies are going to be paying for it and then the other guys insurance has to pay them back.

 

i know you dont have an endorcement and im assuming thier was no police report made either. if you want your shit fixed including your knee you mite have to suck it up if the insurance companies want a police report and take the ticket.

what i want you to do is contact your insurnace company and report it. if you dont have insurance call the other guys. they will instruct you on what to do. your knee is prolly gonna get worse. so call them and let them know you need medical attention and they'll give you all the info you need to take down to the e.r.

 

call his insureance company it was his fault it doesnt matter if you dont have insureance you dont have to on a bike also it doesnt matter that you dont have an endorsement they probaly wont even ask you for it and if they do tell them you dont have one i got pulled over without it and got a ticket just go to the dmv get your permit and pay court cost did you get witness names and numbers

Should have called the cops to file a report at the time of the accident. Definetly take legal action and stick to it...unless you are rich and don't get a shit about money. I was in a situation where my bike was in a hit and run....luckily I had witnesses. After about a month of taking legal action, going back and forth with their insurance company and such, I had my entire bike paid for. Well worth the effort.

I was under the impression that the florida legislature had refused to renew the no fault laws, thereby making this a fault state. Anyone have a link to the relevant florida statutes?

 

Should've called the cops. You could be totally screwed now or at least in for a big court fight. Did you at least get names/numbers of the witnesses. If not, he could just deny everything.

I would highly advise aginst commiting insurance fraud.
