My insurance company told me about that but it doesn't take effect until later this year sometime.

im leaning in a why that this is a good thing thats happening??? because i always hear people complain about the no fault shit.

Well went to the hospital and now im sporting a knee brase(sp) and crutches but other then that all good..

I didn't get any witness's number or anything but when i called his insurance company as advised by someone above and they said he told them he was at fault that he "didn't see me coming" so i don't know if that would work or what but he admitted to his insurance. They also told me to go get medical attention just to evaluate my knee for there information or something, The lady said i would be reimbursed 100% for any medical bill caused by the accident, so thats one reason i went to the hospital but other than that Some repair guy is coming to look at the bike to see how bad it is tomorrow so ill talk to him and see what he says about the guys insurance paying for that also.

No fault only applies to medical injuries and it means that no matter who was at fault for the accident, each party has to file with their own medical insurance company to pay for injuries. That means that his insurance company told you to get medical attention because they know there is no way they will have to pay for it. Getting rid of no fault laws will mean the driver that is at fault is responsible for all medical bills but it will also mean liability insurance rates will go up because insurance companies know they will have to cover other parties involved instead of just you if you are at fault (still better that way in my opinion).

As far as vehicle damage, you should have called the cops to file a police report. Much better to get a hundred dollar ticket than stuck with thousands of dollars in repairs. The fact that he pulled out in front of you means you probably rear ended him... Without witnesses to state otherwise, it is your word against his and by default the person that rear ends is at fault, not the person that got rear ended. I had this exact thing happen to me, someone pulled out in front of me, but witnesses told the cops conflicting stories so it came down to my word against his, as soon as that happened it was ruled my fault since I rear ended him (bullshit, but not much I could do). With no insurance, if that happens in your case you are screwed because it means all expenses will be out of your pocket. Also, if you called the cops, there would have been a record of him admitting guilt and it would have been over. Now he can change his story and you are possibly screwed.

Sorry this got a little wordy, but moral of the story, always file a police report and get insurance! By the way, glad to hear you made it out with only a tweaked knee, hope you heal up quickly.

since you don't have insurance, you will not be able to go get some..then file a claim for somthing that had previously happened.

Try to get his insurance company to pay for everything. If they don't agree to do so, then let them know you will be taking legal action

Take notes of EVERYTHING you are doing to take care of this. Even for phone calls, time you missed at work, just anything that would be out of your ordinary day to day grind. If it comes down to a lawsuit, its best to have everything documented.

u first mistake is didn't call the police for the police report instead trying to do it urself. gl proving whos at fault in the court, now its ur word against his. better yet try to say its his fault to his insurance agency. i dealt with this many times in my squid days.

edit:just read about no driver liscense so get ready to pay his bumper and possible his neck "Cramp" and read my last sentence up there

We'll he did admit fault to his insurance company and they told me they would be taking care of everything from my bike to my knee and 60% of lost work.. So im waiting on the paper work from the shop on the repair info(hopefully totaled) but untill then im gunna try the call gary thing just to see what a lawyer says.

Just to clear it up i hit him right behind his Right Rear Tire and rear bumper.
