Default Crx vs Firebird (caught by cop->advice needed)

A while ago I raced a blue 4th gen hatch (I think a jdm sticker on the rear bumper). I saw it run a 14 flat at BMP, so I knew I wasn't going to win. Well, we hit it at around 70mph, I dropped it into fourth (don't ask, I guess I already knew I was going to lose) and got walked. Fock a ls tranny. That was a quick hatch, anyone know what it has?

I was racing my friends on one of the streets in town. One has a supercharged v6 firebird and the other has a white RSX-S. We raced a couple times and the firebird got me by a car. My vtec just wasn't going to cut it this time. Well, a cop saw us going at it from a light (all three of us). The Firebird got me by a car, the RSX-S spinned and was a little ways behind. The cops were way back there, and we make a turn into a shopping plaza. We then made another turn and that's when we saw the cops behind us, about 100ft away, we lost sight of him after we make the turn into the plaza. I saw some lights in back of us when I turned into the plaza but the cops didn't turn on the blue lights. The White RSX was behind me and the cops was following him for a couple minutes, and then decided to pass him and get behind me. Another cop pulled the firebird over. I received a ticket for Racing on the HIGHWAY.

Okay, I know I did something stupid. Spare me the lectures. It was late at night and there weren't cars around us when we were racing. I'm usually a very responsible driver (hardly go 5 over the speed limit and I use signals and don't cut people off). No ticket in the last four years.

I'm going to court just to see how the judicial system works. I know it's a good possibility that I would lose. I was just wondering if anyone has any advice on what to say. Is racing on a highway an actual offense (like speeding, failure to stop) or is it racing that took place on a highway because I wasn't on one. The cop lost sight of me for a while so he isn't completely sure it was me. He also thought the RSX was me.

I'm trying to change the court day into a later time. Any advice on what I can use as an excuse? Thanks.

316.191 Racing on highways.--

(1) No person shall drive any vehicle in any race, speed competition or contest, drag race or acceleration contest, test of physical endurance, exhibition of speed or acceleration, or for the purpose of making a speed record, and no person shall in any manner participate in any such race, competition, contest, test, or exhibition.

(2) "Drag race" is defined as the operation of two or more vehicles from a point side by side at accelerating speeds in a competitive attempt to outdistance each other, or the operation of one or more vehicles over a common selected course, from the same point to the same point, for the purpose of comparing the relative speeds or power of acceleration of such vehicle or vehicles within a certain distance or time limit.

(3) "Racing" is defined as the use of one or more vehicles in an attempt to outgain, outdistance, or prevent another vehicle from passing, to arrive at a given destination ahead of another vehicle or vehicles, or to test the physical stamina or endurance of drivers over long-distance driving routes.

(4) This section does not apply to licensed or duly authorized racetracks, drag strips or other designated areas set aside by proper authorities for such purposes.

(5) A violation of this section is a noncriminal traffic infraction, punishable pursuant to chapter 318 as either a pedestrian violation or, if the infraction resulted from the operation of a vehicle, as a moving violation.

As you can see the statute is pretty clear and no matter how you cut it you can't really argue that you were not racing.

I would say the best way to possibly get adjudicated is to fess up that you were playing around but state that you didn't spin your tires or exceed the speed limit and ask the court for its mercy. If you are lucky and its your first time you just may get off.

If you go to court the judge will probally have your ENTIRE driving record before him so keep that in mind. Having 2 racing tickets in my lifetime I am SOL any time I have to go to traffic court.

ive been to court once for a trffic violation all i can say is give direct answers YES\NO dont argue, and just be as nice as you can because the judge runs the game lol

as long as you didnt get arrested as Idid A couple of weeks ago, also what was your charge, like a misdameanor(sp) or did you just get a ticket saying you had to pay such amount, and do you have to go to court or was it a decsion of your own? check out my war story in this forum, I told everybody what Igot in court, but your situation is different so Idont know. maxed out, I read your post. Sorry, that was a big punishment. I pretty much received a "Racing on Highway" citation and I elected to go to court. I went to the courthouse to change the date. No excuse was needed, but they say I can only postpone the date once. I was looking at the computer screen and it says officer in training. I guess there is a good chance he'll show up in court.

Unless things have changed lately on your first day in court you will only make a plea and the cop will not be there (but his ticket notes will be there before the judge). If you choose not-guilty you will get another court date at which the cop is supposed to show. Your other options will be guilty or no-contest. You should chose the no-contest option since you are not admitting guilt and you will get to put A FEW words in on your behalf before the judge makes his decision.

When you get to say what happened keep it close to the facts (since the judge will have the notes) and short and sweet about how you and some friends were goofing around in traffic but you were not having a full acceleration race to high speeds.

If your record is clean and the judge is nice he might drop the charge and just give you a fine. If he orders you to go to traffic school, not only will that keep the points off your ticket, but that school will not come out of your 5 voluntary school optiions since the judge is ordering you to go to school.

The judge could be a real bastard and let the ticket stick AND throw hundreds of dollars of court fines on your too.

If the issuing officer doesn't show up to the court room, I thought they threw it out. I had a felony traffic violation (which was bullshit anyways), the cop didn't show up and I was free to go...all charges dropped.
