bottom line is the wreck was the fault of the owner of the bike, NOT the girl that was riding pillion. therefore he's legally liable for her injuries.

exactly why I avoid passengers in my car as much as possible, let alone on back of a bike. The girl is responsible! I'd be really hard pressed to come up with an activity more risky than riding bitch on the back of bike driven by a freaking teenager (edit: with no gear, and no personal health insurance).
