I got a ticket on Wednesday this past week and I am gonna fight it cause it wasn't me that did it so it should be easy. I have fought off a few tickets and I always like to ask people what they think of my case and defense to possibly make it better. Any advice will be appreciated and comments as well. Also, have any of you guys ever fought off your tickets and won, if so what were they and how did you do it? I also have some great books on how to beat tickets if anyone ever wants to use them.

Here is what I am fighting and my defense

Ticket for turning right at 34th ave north onto 9th ave north, clearly posted no turn on red.

Prep:

1. Take pictures of the area, both 35th ave, Haines and 34th, day and night time, around 10:40pm with cars in the picture.
2. At 10:25pm on Wednesday the 3rd of January 2007, I was accused of making an illegal right hand turn from 34th ave north onto 9th st north.
3. Get a map that I can use on an overhead projector or make a big enough one that everyone can see, showing from 1221 36th Terrace North to 35th ave and from 35th ave to 25th ave.
4. Write down all notes.
5. Look up statute 316.074(1)

Notes:

At approximately 10:30pm, I left from my girlfriend Lindas house(1221 36th Terrace North) and proceded to go to work. I made a right onto 12th st. north and then made a left onto 36th ave north. Came to Haines road north and made a right and came to a stop at 35th ave north and 9th street north which had a red light and no signs showing that I was unable to make a right hand turn at that signal when its red(No turn At Signal).

I then proceded to make a right hand turn onto 9th st north heading south. I noticed 3 other vehicles on the road ahead of me once I made my turn, one turned into the Sweet Bay Grocery parking lot, one turned right onto 30th ave north and the other was slightly in front of me, but I did not see where they came from. I drove down 9th street to 27th ave when I noticed a police vehicle approaching me at a high rate of speed with no red and blue flashing lights on, in my rear view mirror.

Once the officer caught up to me she then turned her flashing lights on and I immediately turned into the south end parking lot at Macdill FCU which is at 25th ave north and 9th street north. Once pulled over the officer approached my vehicle and asked me did I know why she pulled me over? I told her that I was unsure, as I had checked if I was speeding once she caught up to me and it wasn't that. She then asked me what street that I had turned from, I responded, that I had turned from 35th ave north and she told me that I was incorrect and that she said I turned from 34th ave north.

Questions:

1. Where were you located at when you saw someone turn right at the red light?

2. It was night time and dark outside, how were you able to determine who it was that made the right hand turn at the light?

3. Being that it took you nearly 10 blocks to catch up to me to pull me over and me obeying the speed limits, that means, you must have been a good distance from me, so that means that you weren't close enough to determine the make, model and color of the vehicle that made that right at 34th ave north and on top of that being after 10pm at night and making it even harder to see due to it being quite dark out.

4. Once you pulled me over you asked me what street I came from, is this correct?


Possible Answers and Responses:

1. (If she says far away or a certain distance for #1), how were you able to determine, being that you were not very close and the visibility was not great and other cars were passing through the intersection, how do you know that it was my vehicle that you saw?

2. (If she says, I saw your tail lights), how do you know that they were mine exactly, once again being that it was late and you were not close to me.

3. (If she says that I was speeding), how can you determine that I was speeding? How can you determine that it was me that made that right turn from 34th ave then if you can't determine that I was speeding?

4. (If she says yes), so that could possibly mean that you are unsure if you had pulled over the correct vehicle? (If she says no), Remember you are under oath! Ask #4 again or re-word it.

 

I sincerely wish you good luck representing yourself.
Be prepared for any off-the-wall answers that you have not yet thought of. Sometimes an officer gets into win-at-any-cost mode, to save face.

Those questions are too hostile - you have put a great deal of effort into preparation. Just tell the judge you didnt do it and respectfully suggest that the officer was mistaken.

If you try to corner a cop you will lose. The judge will either reduce or dismiss your charge if you dress up, present your case reasonably & respectably and maintain composure.

 

If it was a county cop, chances are he wont make the court date. not promising that but in pasco county , about 3 years ago , i ahd a 240 with a headlight out , but it was daylight and i got a ticket for it along with speeding , took it to court ..he never showed up, tossed out no ?'s asked

 

I hope that it just gets tossed, but I would like a chance to fight it for experience.

 

Cops get O/T for showing up at court. In addition, there are procedures which allow them to skate out on court multiple times and just have you show up at another date.

 

ohh i thought State troopers got paid the overtime,cause they will make it everytime.

 

Funny you mention that, cause when I went to fight a ticket last year, there was like 10 State Troopers there.
