wow i'm surprised i haven't gotten anything for my supras lack of a front bumper. i think they just feel sad for me when they see me driving around with the front all fucked up.

I can be convinced of anything when presented with evidence that I can read.
My understanding is; that until I see a Florida statute that says it is a primary offense, that probable cause *IS* still required.
Regardless of what the news media has incorrectly reported for the last 5+ years, and regardless of misleading commercials, there is more to the story........... -Bob

i still can't believe we don't have a flippin cop on here to clear this shit up, where can you find this stuff, i always wear mine, so it makes no matter to me, but i thought it was a primary offense

where can you search for statutes and stuff?

Actually you have been mis-informed. Read on and I shal explain.

Senor honda, since you asked so nicely, here is the link for seat belts.

It states that the driver must ensure that all passengers under the age of 18 have seat belts, if your over 18 then you only have to wear one in the front seats and if they don't they are responsible for it themselves.

The statute referes to a 316.613 and a paragraph with in this statute (316.614) which refers to child safety restraints/seats or persons under the age of 18. This reference is identifying what exceptions to the statute on primary or secondary offense. Basically a traffic stop for a seat belt must be a secondary offense unless the person not wearing a seatbelt is under 18 or not in a child seat as required by law. So if you and your passengers are over 18 then it must be a secondary offense.

(4) It is unlawful for any person:

(a) To operate a motor vehicle in this state unless each passenger and the operator of the vehicle under the age of 18 years are restrained by a safety belt or by a child restraint device pursuant to s. 316.613, if applicable; or

(b) To operate a motor vehicle in this state unless the person is restrained by a safety belt.

(5) It is unlawful for any person 18 years of age or older to be a passenger in the front seat of a motor vehicle unless such person is restrained by a safety belt when the vehicle is in motion.

(6)(a) Neither a person who is certified by a physician as having a medical condition that causes the use of a safety belt to be inappropriate or dangerous nor an employee of a newspaper home delivery service while in the course of his or her employment delivering newspapers on home delivery routes is required to be restrained by a safety belt.

(b) The number of front seat passengers of a pickup truck required to wear a safety belt pursuant to this section shall not exceed the number of safety belts which were installed in the front seat of such pickup truck by the manufacturer.

(c) An employee of a solid waste or recyclable collection service is not required to be restrained by a safety belt while in the course of employment collecting solid waste or recyclables on designated routes.

(d) The requirements of this section shall not apply to the living quarters of a recreational vehicle or a space within a truck body primarily intended for merchandise or property.

(7) It is the intent of the Legislature that all state, county, and local law enforcement agencies, safety councils, and public school systems, in recognition of the fatalities and injuries attributed to unrestrained occupancy of motor vehicles, shall conduct a continuing safety and public awareness campaign as to the magnitude of the problem and adopt programs designed to encourage compliance with the safety belt usage requirements of this section.

( Any person who violates the provisions of this section commits a nonmoving violation, punishable as provided in chapter 318. However, except for violations of s. 316.613 and paragraph (4)(a), enforcement of this section by state or local law enforcement agencies must be accomplished only as a secondary action when a driver of a motor vehicle has been detained for a suspected violation of another section of this chapter, chapter 320, or chapter 322.











for the bumper deal, I can't locate anything That states that a bumper cover must be on the vehicle. If someone who has gotten this ticket could please post up the statute number and title, I will look it up to see how it is worded.

There was talk of it some years ago, but it was just talk. It may have changed from a secondary offense for all violations to a secondary offense for those over 18, but since I didn't look that close years ago I can't say for sure.

Frequently in their haste to be first to report the news, the media gets it wrong.........
and has INCORRECTLY reported for about 6 years that it was a primary reason to get stopped if you were unbelted.

Florida's thinking at the time Bill Clinton threatened to revoke highway funds, was:
If it could be a primary/main reason to stop someone for unhooked seatbelts,
SOME people would be stopped more often than others..........-Bob

Hah, same here... I can't even sit in a car without my mind saying to reach over and put on the seat belt... Not because its more safe (Thats one reason) but mainly because if im not wearing it, I feel like im about to fly out the windshield each time I brake. Your right, it feels like the car is holding you with it on... And I think not wearing it makes you an idiot.

There are some things that I can understand people taking risks on... Such as bikes.. The risk is death, but the chance you take is alot of fun... For seatbelts.. The risk is death.. For a minor minor minor inconvenience.

Remember: Its not your driving you have to worry about... Its the other idiots that will ram you out of nowhere. Thats the real reason you wear a seatbelt.
