Question about accident (No Police Report!)
Hey I got in an accident on 5/02 of this year. Here is how it went down. I was driving through the front parking lot of my school (Jefferson High). In the front of the school there is two lanes going one direction and diagonal parking on the left hand side. On said night though, right lane was tooken up by parked cars. I was driving through the left lane (as were other cars). When I went to to pull into a parking space I was side swiped by a Denali (which was actually driving through the parking spaces to pass the row of cars) going 30-35 mph. Not only did it dent the hell out of my left fender and destroy the support under it, it ripped off my front bumper too. After the accident I went to the Resource officer on school grounds and he just photo copied our personal info (License, Registration, Insurance and phone numbers). I did not call the police or file an accident report.
Here lies the problem. After I reported accident to my company and her's, I learn that they cancelled insurance right after they received insurance card through mail. I only have basic coverage which does not help me but only protects people I get in accidents with. Also the thing is the girl who crashed into me only had a Learner's Permit and was driving her mother's car. I got an estimate of $1800 for her from Amaro's on Columbus and Glen (near Himes), but her mom said thats too much. They want me to take it to this body shop right off of 7th Ave. and 23rd Street, almost in the center of Ybor strip.
Her mother is financially liable for this accident right? Also if they don't want to pay for any damages, including my tire which is cut up from the fender slicing into it, do I have any case in court? Can't the girl who crashed into me have her license suspended until she is 21 or something like that and the mother get into trouble too because it was her car and she let her daughter drive it alone with no insurance? Someone help me I need to know some laws that way I don't sound like an idiot when I meet up with this girl tomorrow. Thanks in advance for the people who actually read this thread and have any input.

wow, sounds like a nasty position to be in.
It might have benefited you to call the police as soon as you got into the accident. Sometimes we try to be nice to the other people by not involving the police/tickets etc.. but in the end those people can sometimes screw us over. Do you have any witneses?? A lawyer maybe?
Ive never been in this kind of position before so the only thing I can say is have a lawyer with you if your going to court, and I dont even think that will be much help.
edit* Is she hot? maybe you can hook up with her and tap it for a down payment.

LOL nah I wouldnt say she was beautiful nor is she even remotely pretty whatsoever, does anyone have any good news/advice? Please I need help and I dont want to get fucked here!

Yo, def get the police involved or atleast conatact them to see if they can help you at all(prob not, cuz what are they good for?) i would also take them to court, they now have no insurance on their car,the girl was driving underage, and they are refusing to pay the fines.
OH, and btw DO NOT, i repeat DO NOT, go to the shop they tell you to go to. You are allowed to pick ANY shop you want for the repairs, no matter how expensive they are. I would suggest either taking them to small claims court, or hiring a lawyer. GOOD LUCK! and dont puss out! Stick it to them like they are sticking it to you!

Ok bad news first, This happened on private property, yes a school is public access but it is still private property. therefore the statutes that govern driving are non-enforceable, so she did not need a drivers license to be driving nor did she need insurance, so the cops wouldn't have been able to do anything for you at the time. Your going to have to take her to small claims court.
The good news though, the school did not properly enforce it's own parking rules which put you in the wrong lane and allowed her to drive across the parking slots....so sue the school.

Twanksta - Yeah Im going to have that shop do an estimate and then I'm gonna find a price I like and then have them pay in cash.. These people don't seem too knowledgable when it comes to the law so I will be bringing my dad with me to give them all the legal mumbo jumbo and scare the shit out of them so they won't want to go to court and so they will just settle for cash.
kender - Yeah that's true but their old insurance company said there was a clause that would still put them at fault and would also still make them financially liable for the repair of my car.
On a side not, I will meet up with her tomorrow and let her know the "deal" and I will get the estimate but I will also let her know that her cheap, hole in the wall place estimate will not be a monetary figure (atleast when it comes to a suit) in the court of law.. WHat I mean by that if that place gives me a estimate of $500, and for some reason I didn't want repairs there, and I chose to sue, I would use my original figure of $1800 plus court costs, lawyers fees, loss of work (by having to meet her up and go to court), and back pain I have received starting the night after the accident..

Her mom owns a Denalli but wants to take your car to some mom & pops body shop? Talk about cheap. They should be kissing your ass right now that your not pursing any lawsuits instead you just want your car fixed the right way. Next time call the police, that way you have a police report that states everything and will back up your case.
did u take picture at the time of the accident? does ure school have cameras over the parking lot, if so grab those videos, get the accident. Bring the bitch to court, and steall the bitches denali!
