question about fraud

Default question about fraud

my brother purchased a civic in ill. from a car dealer and is still paying on it. the dealer never gave him any kind of warning that this car has a salvaged title and was totalled out and rebuilt. my brother is still paying on this car(6,000 left) and it's a 2000 ex. he had to replace a tranny and this costed him nearly 1800 for the tranny and flywheel.(oem) i was just wondering if this is fraud since they never told him anything about this and had no intensions to either. he hasn't got the title because he's still paying for it. if there is anyone here that can find anything out for me i would greatly appreciate he has 2 kids and lives an honest hard working life and doesn't deserve to be ripped off. thanks.

if it had a clear title and it was less than 30 days you could persure him under the florida lemon law but since it has a salvage title hes screwed.

your wrong, lemon law works for 2 years and only on new cars.

the seller must disclose that the car has a salvage title before the car is sold. i would contact the state and see what your rights are.

There is no lemon law on used cars, period.

If the car had a salvage title and it was not disclosed to your brother at the time of sale, it is fraud. It is going to be a difficult battle being that the purchase was in another state. Is your brother 100% absolutely positive he didn't sign anything that may have mentioned the title having a salvage history? They may not have given him a copy, but if he signed anything saying that the car had a salvage history, they did not commit fraud. They may have mislead the shit out of him, but he is responsible for reading what he signs. Just out of curiosity, if it wasn't disclosed, how do you know it is a salvage vehicle without having the title??

Edit: After re reading your post, you don't say it has a salvage title. If the vehicle was sold as-is no warranty, there's nothing your brother can do but make his payments and try to make this tranny last.

he carfaxed it and found out it was totalled out. he says he doesn't recall signing anything that said that because he has 2 lil girls and wants the most for their safety,he would have never signed to it. they never showed him a title at all the bank still has it. and if it was as is no warranty i doubt the bank will give a loan for a totalled car with no warrantyfor 9200 with only 1500 down. thanks for all input. and i am researching the state. he still lives in illinois thanks and keep helpful comments coming.

Have him check and find out if the car has a salvage title or a rebuilt title. There is a difference. If it has a salvage title, and it was not disclosed to him, then he could get a lawyer if he thinks it is worth the time, effort, and he doesn’t want the car. Unless he read all the paperwork put in front of him at the dealership, he just might have signed some paperwork saying he knew it was a salved title. I didn’t think banks would give loans on cars with salvaged titles. Was it a Buy-here Pay-here lot? Where in IL?

Your Bro should contact the state of Illinois Attorney General and ask for
information/statutes related to selling a car, etc., etc., and give him
the info related to your bro's purchase.........as a start

If he truly was frauded, the AG might want to know. If your bro just wants out of a bad deal he got himself into, that's another story.-Bob
