Default Buyer protection

I ordered a hood and lip for my car on june 27th, two months later i havent recived them. I purchased them from a store in california with my visa card. He is telling me i cant get a refund for them because he has the hood in stock. Even though he hasnt shipped it. The lip is on back order. His excuse is that he is waiting for bax shipping to setup an account with him. But it has been like that for months now. Is there anything i can do?

yes, did he ever give you a a delivery date or time frame, like 2-4 weeks for delivery. if so and it has been past that timeframe you have like 60 or 90 days from the promised delivery date, to start a dispute. call your credit card company and tell them you need to dispute the charge from him. tell them he told you it would be delivered by ( insert date), even if he didn't give an exact date your credit card company will want a date so figure out when the order was placed and add the shipping time. tell them you have already tried to settle the problem with the merchant but you are being told that he won't ship the items because he doesn't have an account setup with the supplier, so basically he sold you merchandise that he had no access to, but he refuses to give a refund eventhough he doesn't know when he can get the items.

your credit card company may want you to write a letter to them explaining what has happened, if so pm me and i can let you know what info you should make sure is included. once the dispute is started they will contact the merchant and he will have to show proof that the merchandise was delivered to you, he can't, so you would end up winning the dispute because he failed to deliver the merchandise by the promised delivery date. make sure you tell the credit card company that he does not know when he will be able to ship out the items and you can't wait, since it is car parts.

Thanks i talked to him, he said he will ship them out this week, if he doesnt i will be contacting my card company.

get him to nail down a delivery date, or a no later than date, that way if he does screw you the credit card company will be able to dispute it. if he never gives a delivery date then the items are not technically late.

That sucks man. Some people don't know how to run a business.

If you waited just another month or so. I am developing a composite body part line for hondas right now.

Working on a hood, door panels and fender all made out of carbon fiber.
