accident help!
speed limit=40. i was driving 45.
i was just driving south in the left lane on a 4 lane road with a turn lane in the middle. an elderly man in a late-model mazda truck pulls out infront of me to turn into the northbound lanes, but stops with the front half of his truck in my lane. i slam the brakes on my 2000 honda civic ex, and i slid about 35 feet and slam into his driver side fender. we both pull into the nearby parking lot. cops/firefighters/paramedics show up about 1 minute later. the elderly man happens to have a suspended liscense and an out-of-date temp. insurance card. i dont have proof of insurance because i just cancelled the policy on my other car, and was told i have 30 days to switch it to the new car(so i got a 70$ ticket). the cop writes up the report, and gives the man a citation for the accident. They said it was his fault, but she also told me to slow down because "my skid marks were too long to be going 45", which is bs.
anyway, my hood is fubar'd, my driver side fan is broker, radiator is bent, bumper support is bent, and im pretty sure the frame is bent.
my question is....because its florida no fault, does that mean that I have to pay to fix my own car, or will his insurance do it? the cop gave me a card with his number and case number and stuff, so ill call tomorrow to see if i can get a copy of the report. just looking for some info to see what i should do. thanks.

The old guy is car 1 in the accident and you are car 2 1=at fault
Get the police report and contact his insurance immediately. Contact the insurance company now before the police report. the cops should have given you everything before they left to begin with. Stay on everybody. No one is going to keep you in the loop on thier own you must stay on top of everything or nothing will get accomplished.
Good luck and keep us posted

If his insurance accepts liability on the accident, then they will be covering the damages. If not, you will have to pay your deductible, and your insurance company will pay for your repairs, then subrogate back to the other guys insurance company to recover the monies paid for your claim + your deductible.
i tried to call the police today and get a copy of the report, but the officer doing the case was on a call and the records people had already closed for the day so im going to call 1st thing monday.
i cant call his insurance company til i get the report with his insurance companies name and number on it, along with his policy number.
my new insurance guy said it would be about a 3 day job, if not longer.
ill get some pics of it, and thanks for your help everyone.

this all seems way out of wack. There should have been what they call an exchange of information form or short form or some kind of amicable exchange between you the officer and the other party.
This sounds like some hazzard county bullshit to me. The officer should have overseen the total exchange of information and the fact that fault was not established and copies of the paperwork not given to all parties sounds shady at best.
Not looking good so far.
