Default Issues w/Ebay seller

I'm having my first experience with a questionable Ebayer and I need some opinions on what to do and how to approach the issue...

My frist clue as was the payment method. He only took USPS money orders and they must be received by him no later than 5-days after the end of auction. He didn't take Paypal. I researched his history and he came up very clean. No negative rep. All positive comments. Everything seemed okay.

So I end up winning the item. Bidding ended on Christmas Day. I shoot him a message adivsing I would get the money order and mail it out the following day. I send the money order out USPS Priority Mail. Tracking number verified it was delivered to his home the following Saturday (5-days after the end of the auction).

Fast forward to the following Saturday (7-days later). No package. THe guy lives in Virginia so I should have had it by now. No messages/email from the seller. You'd think I'd at least get some sort of update. I'm a bit pissed. So I send him a message asking for status. He gets back to me in about an hour stating he would send it out Monday and he would send me a tracking number. No biggie.

Monday passes. No message or email. Figure I'll give him a few days to see if I get a message or get a package on my door. Well today is Thursday and no package. No email. No message. Nothing.

I send him another message asking for the tracking number. He gets back to me now stating it will be sent out FRIDAY!!!

Am I jumping the gun here on being pissed off? This guy has been sitting on my money for almost two weeks now and hasn't bothered to ship it out. Should I sit it out another week? Should I contact Ebay to get things in motion?

I've never had an issue on Ebay so I'm at a bit of a loss on how to approach this without screwing myself of my money and/or the item.

since you mailed a money order it takes longerfor thinkgs to arive in the mail especially this time of year.. if he has all positive and no negatives give him some slack as holidays slowed us all down

No, seriously though - I'd just email him, and calmly state my concern(s), and let him know that if he cannot provide you the service he originally advertised/promised - then you will begin to take the necessary steps to resolve it through eBay directly.

Then, regardless of when/if you get the stuff - make sure you leave him feedback ACCORDINGLY - not just based on your first reaction. I've received negative feedback from someone, when in actuality I should not have (they received the items late, as it was stuck in customs)...

What really got me was this part in his item description... "Payment must be received no later than 5-days after close of auction. Deadbeat buyers will be dealt with accordingly."

Pisses me off that I have to pay him ASAP "or else"...but he can sit on his ass and ship this thing out whenever he feels like it. I'd understand if this were delayed by UPS/FedEx/USPS. But this is purely this seller not packing up the item and getting it out in the mail. Holidays or not, it shouldn't take someone 13-days after reciept of payment to get the shipment out.

Guess I am just frustrated because this isn't how I operate. If someone gives me money for an item I ship that damn thing out within 24-hours. It doesn't matter if it is Christmas, Flag Day, Black History Month, etc....I'm getting it taken care of.

you can always start a dispute, all that will do is Ebay will contact him asking for tracking numbers. If he don't respond then Ebay will take further action. USPS Money orders make it a federal offence (mail fraud)if he don't send the item.

Ebay won't so shit. I got fucked for $425 on a t5 from an asshole that only took money orders. He scammed me and others for over 2k and Ebay did nothing. Paypal from now on. Ebay does not give a shit about anything but them selves. And just a head up they also own paypal. As far as the federal offence for it being postal money order. i did the same thing and if you think the federal government cares about that you are in fantasy world.

Did you use a USPS money order?

I know I did for a $680 auction and was scammed. Ebay sent me the papers and I filed with the Post office, next thing I know US marshalls are stopping by and taking all the info. Three weeks later I had a $680 USPS money order in my hand and I had to send back a written statement for the prosicution.

DON'T leave negative feedback...becuse then he will leave YOU negative feedback and as the seller, he always gets the last word.....and he doesn't have to leave feedback till he feels like it...

This is a big issue I have with ebay...I got screwed over by it.....I feel that, as a buyer, once you have submitted your payment and it clears, the seller should have to leave your feedback because you are basically done with your responsibilities......but this is not the case......the seller doesn't have to leave till they feel like it and they typically don't till the buyer does.....and if there is a dispute through the feedback, they always get the last word...only way to fix it is to mutually withdraw, if they agree..

I got screwed over by some asshole seller this way....so don't do it if you care about your rating
