Well , On my way home from palm harbor tonight , and NOT on my bike , i get pulled over.... He even got on the loud speaker and told me to pull off at the next exit... this is US 19 just before best buy....I knew immediately it was a state trooper... They take their jobs way to seriously....He informs me that i have a tag light out.... I didnt know , so i accepted the ticket , was very polite which is unusual for me...i signed the ticket and then he asks me if i had been drinking.... I said No , which was the truth... he asked me if i had been using illegal drugs.... I said no , then asked why... he said cause he could smell the smoke... He asked me if i had any pot on me.... I said no..He asked me if i would mind if he searched my truck.... I said i did mind cause he had no grounds.....Now my smart ass was startng to come out... he made me step out of the vehicle.... put my hands on the hood and stand there... another cop showed up , a local clearwater cop who stood there with em while the fat shit searched the truck...Trucks not even mine , it was my buddies.... He had some prescription pain killers in the glove box.... cop questioned me on them , i explained it wasnt even my truck and the pill bottle matched the registration...so more or less he had me there for 45 minutes , even the clearwater cop said it was rediculous and he apologized to me for the inconvienence....
lol , so my question here , Is that an illegal search....?... i have yet to go down this road with a cop , usually on my bike theres not a whole lot to search...

 

he said he smelt smoke so thats a probable cause, i unno wild guess but i think it maybe right.

 

he's a dirt bag but one with a badge, so they can do what the please.



you could try to file a complaint but I dought it would do much good. may be nice if you had the other cop's name and badge number thou.

If you got his badge number call his Sarge and file a grievance report. Yes, if he really smelled smoke the Supreme Court has ruled that it is probably cause...if you smoke pot just eat the ticket and shut your mouth, but if he was lying start a ruckus over it.

 

did you leave the truck door open when you got out of it? there was a pretty good video on here like a week or 2 ago about what to do in that kind of situation

 

next time dont roll the window down... do like on that video and crack that bitch about 2 inches... cant smell my fart with only 2 inches!!

beware tho, if you get technical with them they can write you tons of bullshit tickets. even if you just rolled off the showroom floor. maybe if they "smell something" say that you do not concent to them physically searching, but do concent to a K-9... if they reallllly wanna search there car they techinally have to wait till the k-9 gets there. but unfortunatly so do you.

 

File a complaint. Sure, a single complaint probably won't make a difference...but if everyone filed a complaint when BS like this happened, things would change.
