i've been discussing this with a few friends lately and i can't find much info on the net about the subject, but where is the borderline for when a cop can and can't say you have an illegal modification and can make you pop your hood? i'm curious as to what the "actual" laws are for this.

i'm one of those people that give traffic cops a hard time, and i know a few ways to fuck them over on a traffic stop, but i want to know when you can basically say "no" you don't have probable cause for a modification.

 

this is a good question.

a friend of ours drives a BMW 7 series. its basically a garage queen but he and his wife brought it down to Miami for a function. on their trip home a cop pulled them over for no infraction but to do an inspection on the car stating they were aware of drug traffickers. he of course let them inspect the car because he does not do nor sell drugs of any kind.

after they returned home he contacted an attorney friend who told him he should have refused the search of his car. i can't remember the details as to why or what right he had, but he did have a right to do so.

so if anyone can chime in on this it would be apprecaited and i'll try to find out more about what he was told when i see him next.

I think its all about probable cause. Just because they are aware of drug traffickers doesnt mean he is one. They have to have some kind of reason to pull you over to search i.e. thick smoke coming out of your window because your smokin too much of that shit. Its like the exhaust thing. I got pulled over one time because I had a loud ass fart can on my car when I got it, and the cop told me that the only reason why he pulled me over was because it was so loud. He knew it was modified and therefore had probable cause to pull me over. I told him I got the car that way and I was workin on getting rid of it cuz that shit was annoying and he let me go. As far as other mods are concerned I donno how or why they could find cause to pull you over. Just ask them why and and why some more. They have to have a legitimate reason to pull you over. If they dont have one, you shouldnt have to show them shit. You have rights and they are just another person doing their job. Some pigs just take advantage of their power with their guns and badges and think they are tough shit and they can get away with anything.. it sucks

 

Just being honest but most of the time a police officer will pull you over for your "exhaust" if they want to check for other stuff. Let's be honest here...most people with the louder exhausts and the bigger than OE tips are high school kids. They are checking for underage drinking/drugs/other parafinalia.

 

yeah i know that if a cop asks to "search your car" you can simply state that you don't give consent for any searches or seizures. this states that you aren't saying "no" but if the officer doesn't have probable cause (plain sight law) and he searches your car anything found must be dismissed in court.

starting in the early 90's i know cali started putting restrictions on vehicles to try and stop street racers from modifying there vehicles such as bumper height, lense color, tinting, headlight placement, taillight colors, exhaust noise (DB's), and stating that all street legal vehicles running aftermarket parts must have an ID number and bar code printed on the mod stating it was 50 state legal. i even saw once that there is a horsepower restriction on certain motors, how the fuck they'd test that i don't know...

 

Well that's cali...they are a bunch of fucking ignorant assholes over there.

As for florida, they recently changed the exhaust law from...no modifications effecting emissions...to...no modifications altering the factory exhaust system...ie. NO MODIFICATIONS PERIOD.

Time for exhaust cut outs from 3" header collectors going into factory exhausts ...cop can't tell it's not factory as you pull away and then just tip in the throttle past 3/4 of the way and BAM exhaust cut out opens ha ha...love to see the look on the cops face then since he couldn't physically SEE that is what is making the exhaust loud.

 

simply putting a Tuffy brand muffler on your car would be altering the stock factory exhaust because it may be the economy muffler compared to what the factory used.

silly law if you ask me.

and now the manufacturer's are offering exhaust modifications with dealer install. i heard of a guy that had to fight that one in court. the judge dropped the charges when he presented all the paperwork from the dealership. it was a Mazda i believe.

 

Nismo for nissan too...been looking into a 370z and wanted some stuff done to it but am so afraid to get a dumbass cop pulling me over and giving me a hard time over my brand new car
