Unless you witnessed the accident, there is no way you can know who was at fault. The articles just say a motorcycle was traveling at a high rate of speed and somebody tried to cross the road in front of him. High rate of speed could mean anything. He could have been doing 5mph over the speed limit or 50mph over the speed limit. Hell, he could have been doing 5mph under the speed limit and the reporter just interviewed someone who assumed he was speeding. The driver of the car trying to cross the road could also mean almost anything. Maybe they are half blind and not completely there mentally because they are old and just didn't see the bike coming so they pulled out directly in front of it. Maybe they did everything they could to check that they were clear and the bike came flying around a blind corner and there was nothing they could do.
In any case, this guy is now fighting for his life because he or the driver of the truck fucked up and made a mistake. I know everyone on here likes to think it could never happen to them and all, so therefore the rider must have been doing something stupid, but I can tell you from experience that is not always the case. Sometimes people just pull out right in front of you and no matter how slow you are riding, how diligently you are scanning for other motorists doing stupid things, or how well you anticipate that anyone could pull out in front of you at any time, there is still just no time to react. The only way to absolutely prevent this type of accident is to do like 10mph, which obviously poses it own safety issues in 55mph traffic, and still you could get rear ended and squished anyway.
Best of luck to the down rider. The mandatory safety class is a great idea for the biker community, but mandatory behind the wheel tests need to be implemented for EVERYONE every five years or so. There are just too many drivers out there that can barely operate their vehicles.
