You are driving, so you are responsible.....same as if there were drugs under the seat...."oh, it's not mine officer" "sure"....same if the tag is expired, or no insurance, or whatever.....
Now, if the officer was resonable, and you could prove to him you were a grease monkey just testing the car, he would probably not stroke you, but....."technically", they could.
Oh, for what it's worth, I tried removing tint from car windows myself once and it was a BITCH!!!!
I would recommend just taking it to a tint shop and they'll remove the old for a small fee and just get the new, legal tint at the same time.
