This is a prime example of why I don't brake check. Getting hit won't make you rich. All that you get is enough to fix the damage. Meanwhile, you have to drive around with a smashed ass rear end and part with your car for a while when you finally get it fixed. The way I see it, not only does getting rear ended not make you rich, it actually costs you money due to your insurance premiums going up(news flash, they go up even if you're not at fault). Not to mention the hassle that comes with dealing with any matter of the law.
Oh, and if you rear end someone, it doesn't matter if they brake checked. All they have to say is that a squirrel ran out in front of them. Even with witnesses, there is no way to prove them wrong. Just because an impartial driver will testify that he didn't see anything, doesn't prove it didn't happen.
It doesn't make you rich, but it can easily net you a little if you play your cards right. When I say sue, I don't mean for 5 million dollars... hah.
The guy that was hit by the guy I hit was going to sue me for a few k that my insurance would have covered but he decided not to go through with it.
