Certainly if anyone causes serious injury brake checking they are going to have to answer for it. It won't matter if they were "teaching a tailgater a lesson." In that case, if I had the choice, I would rather be the tailgater than the brake checker.
For some reason, you seem to think that the cop would believe you when you said I brake checked... Read up Fl. law... 99.9999% of the time you ram into someones bumper, its YOUR FAULT NO MATTER WHAT THE OTHER CAR DID.... The only things this doesnt apply too is someone who pulls in front of you (And even then you need witnesses) or someone doing a U-Turn and pulls in front of you.

But if you are following too close and someone hits their brakes and you hit them... It is 100% your fault. Unless you have some extremely credible witnesses. Hell, all you would have to say was I was avoiding a car in front of me...A car cut in front of me...A kid was about to walk in the street.. A large dog ran across the street...etc... And then the tailgater is guilty. Period.
