You arent at fault but youll never prove it. Brak checking someone is illegal but you can never prove they brake checked you. Theyll just say they saw something in the road and hit the brakes.... Technically your supposed to be behind someone far enough that they can slam on there brakes and you will be able to stop with out hitting them..
