if you pulled it on him then you should have backed off when he got in front of you. for him to force you onto the median when he's in an eg and your in an explorer means the driver needs to learn how drive. he may have been tailgating, which you could have simply slowed down to force him to pass, but by brake checking him you threw the first punch. sounds like your driver tried to pull something and the civic just drove circles around you, the driver couldn't handle the explorer so he shouldn't have pulled that kind of shit in a vehicle that's too much for him. You may have had to swerve to avoid hitting the civic, and I can see why you say it's his fault, kinda like swerving to avoid hitting a dog, however in the eyes of the law and your insurance you were the one to strike another vehicle, or if you didn't hit any other vehicle then it's a single vehicle accident. Truthfully you should have let him hit you when he was trying to force you into the median, then it would have been his fault, otherwise you unsafely left your lane. I am glad everyones alright, but don't pull shit on the road if you can't handle the car. learn to drive before you get onto the streets, you could have seriously been hurt.
