First, it depends on whether or not there was a will. If there was a will, the will has precendence.
Second, If there was no will, than depending on his "State of residency", ie, where he lived, it could go to Probate or possibly Community Property.
I do reccomend that you see a lawyer if there wasn't a will.....Probate is messy.
