Well, we just got a Domino's here where I live, and I wasn't super impressed to be honest. I never saw what the big deal was. Mediocre pizza in a red and blue box? But, their treatment of a channel that I just stumbled upon a half hour ago, with a seemingly decent car guy just trying to make videos makes me not want to do business with them ever. And that's the end game for the viewers (you listening Domino's?).
This smacks of United Airlines as far as treatment of people and potential customers goes. Samcrac, I'm sorry that you've had to go through all this. This is the world we live in, and it's companies like this that have outgrown their humanity. You've got a new Subscriber though!

Hey Sam, don't let them bully you. You're on the right, regardless of them owning the trademark. If they wanted the logos removed, then it was their responsibility to take it off after the accident and before the insurance company purchased it. -- just like any owner of a car that becomes totaled, you take what's yours before you hand it over. If not, then you are aware that the car could be auctioned off. Domino's owns the trademark, but in essence forfeited their right to remove their branding when they signed the title over. THEY SHOULD HAVE KNOWN TO REMOVE THE BRANDING!



Many companies remove branding when they get rid of old stock and sell to wholesalers, it's not a new concept at all. If Domino's has any legal standing, then it might be with the insurance company or with Copart, but that's only if either one of them promised to remove the brand. If no promise, then Domino's has no recourse except to bully. Question, if you buy a DeLorean that was used in "Back to the Future" and then passed through a few owners only show up in your hands, would Universal Pictures have a claim of copyright infringement if you made a restoration video. Of course the hell not!

Same with kids restoring old Air Jordans, or a restoration of The Batmobile. This is open and shut fair use and they know it. Don't let them intimidate you. The law is so clearly on your side that they actually might get reprimanded by a first instance judge in pretrial. If they bring it to that point, be sure and countersue, haha!

Have you ever thought about getting to the bottom of "why" they want this vehicle back so badly? I can understand why Domino's Corporate would want the vehicle dismantled, but why a franchisee ? That seems really fishy to me.

I suppose it could be because the franchisee is facing legal liability from Dominos Corporate for improperly disposing of the vehicle, but even then, surely the legal costs of picking on you, would not be insignificant compared to any legal penalty that they would receive from Corporate. I guess what I'm really saying is, why is it so important to them?

To Domino's: It's just business... 750k views of a video in 3 days and now 350k views in 24 hours = how much lost business? You could have offered this guy a ton and received positive results. Now, you have ruled your empire with a the sword, scared every franchisee who owns one of these vehicles, and lost millions in revenue. Good Work. I hope a competitor buys this car and plasters their logo all over it. Such as, "Papa Johns buys a salvaged Domino's car and delivers pizza's to Orphanages, VA Hospitals, and the Homeless. The now Papa Johns Delivery Car rose from the ashes like a Phoenix to spread good will."

I commented about this a bit in the post from yesterday. Basically there is something you do when you sign over a title of a vehicle to a second party, whether that party is insurance, a person or another company of any kind, you are signing a "release of interest" to said vehicle.



Now if you have not removed all of the logos or devices from said vehicle you are out of luck. You released interest in said property. Now that simply means you do not have to do anything they ask... They released interest in the vehicle while it still had the livery of it's previous life. Many vehicles are sold this way, and it's the responsibility of the seller or previous owner to remove any markings or devices that they do not want on the vehicle when it is turned into the wild. This includes corporate logos and trademarks.

You as the new owner cannot use the vehicle to deliver pizzas in, or represent the company the car used to belong to. That would be a trademark and copyright issue.If they were so worried about their corporate or franchise image then they should have taken more time to sterilize the vehicle after it was wrecked.
