aight heres the plan go park your car where you know it will get towed and have a crazy ass mofo out there posted up with a gun!!!!! lol na but it may be worth a SHOT!!! to go out there an catch them doing similar damage to someone elses car and get it on video! just a lil something else to run with!

My mom checked with better business bureau and they told her that the tow company that towed me already has 7 complaints against there business in the past 30 months and that this company failed to respond to any of the complaints. So mines will be the 8th "reported" complaint that is lodged against them...

a few things.
first, an all wheel drive vehicle can be towed with a "regular" tow truck otherwise known as a wheel lift. there are three ways to tow an all wheel drive dsm and many other all wheel drive vehicles for that matter. first, the vehicle could be put on dollies. this is the easiest of the three ways to tow an all wheel drive vehicle. second, the driveshaft could be disconnected by unbolting the shaft from the rear differential. the third way is possible if the towing company uses a sling style boom, puts the car in neutral and lets all 4 wheels spin freely...two on the ground, two in the air untouched by the sling itself. as far as the tow itself, the entire situation is a "civil matter" and you would have to sue this company in small claims court...which is very difficult to do and costs you money. |

as far as your car and damage done to the viscous coupling center differential. i own a dsm and the differential will allow the back wheels to spin freely (with the front wheels not spinning and if the tranny is in neutral) for a short distance. (usually 50ft or so)
the differential will then lock up causing the rear wheels to not spin freely. any coherent individual should feel the rear wheels locking up and stop trying to pull the vehicle before damage occurs. as far as this towing company and their drivers...who knows. i can't speak to their ability level...but i would be surprised if they actually damaged your car. |

The car was certainly dragged more than 50ft just by the looks of how deeply the tires are gorged (flatspotted pretty bad), BUT being that the ebrake was pulled and kept the back tires still for the most part, I feel safe to ASSume that the drivetrain is ok even if it rotated a little bit. Chet do you have any advice as far as getting the company to want to own up and pay for my rear tires? This company seems very shady. I filed a report against them with the better business bureau and Im the 8th filed complaint. My mom has also spoken with the dean of the school and the property owner for Hawks landing and if we can even get them to reconsider their contract with this tow compay, and DROP them that in itself would still hurt their company and still be a huge moral victory. |

my advice.
don't waste your time. while the towing company sounds negligent and responsible for the damage, you would have to prove in civil court that they were the ones to damage your car...and by the time you go through that process you'll have spent way more than what it costs to replace your tires. believe me when i say this, cut your losses and don't park where you're at risk to be towed. thats the best advice i can give you. |
