need help axle problem

i just did a h22 swap in my accord my passger sid axle keep sliding out i put a brand new one in when doing the swap so what could it be

I guess it could possibly be but I have never seen it actually be the tranny. Most of the time the c clip thing on the axle doesn't get completely seated in the tranny therefor not locking the axle in. Get it in as far as you can push it then line up the axle to be completely straight. Next you will push on the end of the axle compressing it as much as possible...while doing this a friend will smack the tip of the axle that goes through the hub with a hammer. After a few good hits you should feel it clip into the tranny. Put the nut on the end of the axle before you hit it with the hammer so you can protect the threads.

because it was in 2 times i get on it hard turning back and forth popping the clucth to see if it falls out and it does not its when i am taking it easy just falls out u can hear it free spinning could the clip brake

Maybe the splines are stripped inside the tranny...when the axle is out check inside the tranny and see what condition the splines are in.

worn diff, see how much play the axle has (up, down) when installed, the tube is probably worn in the diff and the axle keeps poping out...
